Variation to Licence Area Plan – Broken Hill Radio – No.1 of 2013

1. Enabling legislation

The Australian Communications and Media Authority makes this instrument under subsection 26(2) of the Broadcasting Services Act 1992.

2. Name of instrument

This instrument is the Variation to Licence Area Plan – Broken Hill Radio – No. 1 of 2013.

3. Commencement

This instrument commences on the day after it is registered.

4. Variation

The Licence Area Plan – Broken Hill (Television and Radio) – February 1996 determined by the Australian Broadcasting Authority on 23 February 1996 is varied as follows:

(a)          rename the instrument as “Licence Area Plan – Broken Hill Radio”;

(b)          amend the heading on the title page so that it reads “Licence Area Plan – Broken Hill Radio”;

(c)          on page one:

(i)            amend the heading so that it reads “Licence Area Plan – Broken Hill Radio”;

(ii)         omit clause (1) and substitute the following clause: 

“(1) This plan for radio broadcasting services in the Broken Hill area of New South Wales is made under subsection 26(1) of the Broadcasting Services Act 1992.”

(iii)       omit clause (2);

(iv)        omit clause (3) and substitute the following clause: 

 “(3) Five national radio broadcasting services, two commercial radio broadcasting services and two open narrowcasting radio broadcasting services are to be available in the Broken Hill area described at Attachment 2.1 to this plan with the use of the broadcasting services bands.  The characteristics, including technical specifications, of the services that are to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 - 2.10 to this plan.”

(v)          amend clause (4) to omit the word “Determination” and substitute the word “plan”; and

(vi)        insert the following clause after clause (4):

 “(5) A reference in this plan to a schedule or an attachment includes reference to a schedule or attachment as amended from time to time.”

(d)          omit Schedule One;

(e)          omit Schedule Two and substitute Schedule Two of this instrument;

(f)           in Schedule Three omit the heading “Licence Area Plan – Broken Hill – (Radio) – February 1996” and substitute the heading “Licence Area Plan : Broken Hill Radio”;

(g)          in each of Attachments 2.2, 2.3, 2.4, 2.5, 2.6, 2.8, and 3.2:

(i)            omit the heading “Licence Area Plan – Broken Hill” and substitute the heading “Licence Area Plan : Broken Hill Radio”;

(ii)         under “Site Tolerance :” omit “Refer to Technical Planning Guidelines” and substitute “Refer to Broadcasting Services (Technical Planning) Guidelines 2007”;

(h)          omit Attachments 1.1, 1.3, 1.4, 1.5, 1.6 and 1.7;

(i)            omit Attachments 2.1, 2.7, 2.9 and 3.1 and substitute Attachments 2.1, 2.7, 2.9 and 3.1 of this instrument; and

(j)            after Attachment 2.9, insert Attachment 2.10 of this instrument.
