1 Name of Determination

  This Determination is the Electricity Supply Fees Determination 2013.

2 Commencement

  This Determination commences on 1 July 2013.

3 Revocation

  The Electricity Supply Fees Determination 2012 is revoked.

4 Definitions

  In this Determination:

billing period means each successive period during which a customer is billed for electricity consumed.

domestic supply means the supply in a controlled manner to a residence.

domestic supply controlled off-peak, for a domestic supply customer, means a supply that is periodically switched on and off for load control reasons by time switch controls located in the customer’s residence switchboard.

fee means a fee payable by a customer for electricity supply or another related service at the rate mentioned in this Determination for the supply or service.

general supply means a supply of electricity to a customer that is not:

 (a) a domestic supply; or

 (b) an 11kV time-of-use demand supply; or

 (c) a LV industrial supply.

general supply controlled off-peak, for a general supply customer, means a supply that is periodically switched on and off for load control reasons by time switch controls located in the customer’s premises switchboard.

GST has the meaning given by section 195-1 of the A New Tax System (Goods and Services Tax) Act 1999.

new account supply connection fee means a fee associated with the work necessary to connect supply for a new customer.

off-peak period means a period that is not a peak period or a shoulder period.

peak period means:

 (a) 7 am to 9 am on a week day; or

 (b) 5 pm to 8 pm on a week day.

shoulder period means:

 (a) 9 am to 5 pm on a week day; or

 (b) 8 pm to 10 pm on a week day.

week day means a day that is not a Saturday or a Sunday.

5 Fees for supply of electricity

 (1) The fees for supply of electricity are set out in:

 (a) for domestic supply in a billing period — Part 1 of Schedule 1; and

 (b) for domestic supply controlled off-peak in a billing period — Part 2 of Schedule 1; and

 (c) for general supply in a billing period — Part 3 of Schedule 1; and

 (d) for general supply controlled off-peak in a billing period — Part 4 of Schedule 1; and

 (e) for LV industrial supply in a billing period  — Part 5 of Schedule 1; and

 (f) for an 11kV timeofuse demand supply — Part 6 of Schedule 1.

Note   A general supply customer is normally a business customer who is not a domestic customer or a large industrial customer.

 (2) If a customer is a pensioner, the fees for domestic supply are subject to a rebate of $0.5900 for each day, to be applied before the application of GST to the customer’s account.

 (3) If a customer is dependent on life support or constant positive airway pressure respirators, the fees for domestic supply are subject to a rebate of $0.8300 for each day, to be applied before the application of GST to the customer’s account.

6 Fees — miscellaneous

  A fee for an item mentioned in Schedule 2 is the amount mentioned in Schedule 2 for the item.

7 11kV timeofuse demand supply

  If a customer has a minimum use of 200 kVA of electricity per month, the customer may be connected to 11kV time-of-use demand supply.

8 LV industrial supply

  A customer may be connected to a LV industrial supply of electricity if:

 (a) the customer has consumed more than 160 000 kWh of electricity in a previous 12month period; and

 (b) the customer requests low voltage industrial supply.

9 Period for payment

  A fee for the supply of an item mentioned in Schedule 1 or 2, must be paid within 14 days of the day a bill is issued for the amount of the fee.

10 Non-payment of fees

 (1) The notice of disconnection delivery fee mentioned in item 5 of Part 2 of Schedule 2 is payable if a fee is not paid by a customer within 18 days after the expiry of the period mentioned in section 9.

 (2) If a fee is not paid by a customer within 6 days after the delivery of a notice of disconnection, the supply of electricity to the customer may be disconnected and the combined disconnection/reconnection fee mentioned in item 1 or 2 of Part 2 of Schedule 2 is payable.

 (3) If a supply of electricity is disconnected under subsection (2), the customer must not be reconnected until the customer pays the outstanding amount of the electricity fees and any fees payable under subsections (1) and (2).

11 Refund of security deposit

 (1) This section applies if:

 (a) a customer has paid a security deposit for a supply of electricity; and

 (b) the customer requests that the supply of electricity be disconnected; and

 (c) the customer receives a final account for the supply of electricity.

 (2) If the customer pays the final account in full, the Department will refund the security deposit in full to the customer.

 (3) If the customer does not pay the final account in full, the Department will retain the amount owing on the final account and refund the balance of the security deposit to the customer.
