Variation to Licence Area Plan – Wangaratta Radio – No.1 of 2013

1. Enabling legislation

The Australian Communications and Media Authority makes this instrument under subsection 26(2) of the Broadcasting Services Act 1992.

2. Name of Instrument

This instrument is the Variation to Licence Area Plan – Wangaratta Radio – No.1 of 2013.

3. Commencement

This instrument commences the day after it is registered.

4. Variation

The Licence Area Plan – Wangaratta (Radio) – September 1997 determined by the Australian Broadcasting Authority on 15 September 1997 is varied as follows:

(a)          rename the instrument as “Licence Area Plan – Wangaratta Radio”;

(b)          amend the heading on the title page so that it reads “Licence Area Plan – Wangaratta Radio”;

(c)          on page one:

(i)            amend the heading on page one so that it reads ”Licence Area Plan – Wangaratta Radio”;

(ii)         omit the sub-heading “Determination”;

(iii)       omit clauses (1) and (5) and substitute the following clauses:

“(1) This plan for radio broadcasting services in the Wangaratta area of Victoria is made under subsection 26(1) of the Broadcasting Services Act 1992.

(5) One community radio broadcasting service is to be available in the area described at Attachment 2.1 to this plan with the use of the broadcasting services bands.  The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 - 2.3 to this plan.;

(iv)        in Clauses (2), (3), (4), (6) and (7) omit the word “Determination” and substitute the word “plan”;

(v)          in Clauses (2), (3), (4) and (6) omit the word “(Wangaratta);

(d)          omit Schedule Two and substitute Schedule Two of this instrument;

(e)          in Attachment 1.8 following “Nominal Location : omit  Cnr Boorhaman & Richardsons St Wangaratta” and substitute “Broadcast Site cnr Boorhaman Rd & Richards St WANGARATTA”;

(f)           in Attachment 1.9 following  Nominal Location : omit “Wangaratta” and substitute “Broadcast Site WANGARATTA”;

(g)          in both Attachments 1.8 and 1.9, following Site Tolerance : omit “Refer to Technical Planning Guidelines” and substitute “Refer to Broadcasting Services (Technical Planning) Guidelines 2007”; and

(h)          after Attachment 2.2 insert Attachment 2.3 of this instrument.
