Financial Management and Accountability Act 1997

I, PETER GIBSON, Acting First Assistant Secretary, Financial Reporting and Cash Management Division, Department of Finance and Deregulation, make this Determination under subsection 32(2) of the Financial Management and Accountability Act 1997 (the FMA Act).

 

This Determination is made due to a decision of the Australian Government to establish a new statutory authority, the Independent Hospital Pricing Authority, for which appropriations are transferred from the Department of Health and Ageing.

1 Name of Determination

This Determination is the Financial Management and Accountability Act 1997 Determination 2012/20Section 32 (Transfer of Functions from HEALTH to IHPA).

Note 1: This Determination has been made by a delegate of the Secretary of the Department of Finance and Deregulation. The Secretary is a delegate of the Minister for Finance and Deregulation in accordance with section 62 of the FMA Act. The Secretary has delegated his power in accordance with section 53 of the FMA Act.

Note 2: Acronyms used in this Determination are as follows:

(a)       HEALTH – refers to the Department of Health and Ageing

(b)       IHPA” – refers to the Independent Hospital Pricing Authority

Note 3: Appropriations from HEALTH are being transferred to the newly established IHPA.

2 Commencement

This Determination commences on the day on which it is made.

3 Amendment of Appropriation Act (No. 1) 2011-2012

 Schedule 1 amends Appropriation Act (No. 1) 2011-2012 to:

(a)   reduce the departmental item for HEALTH by $333,134.22;

(b)   reduce the administered item alongside Outcome 13 for HEALTH by $19,967,430.00;

(c)   increase the departmental item for IHPA by $16,613,134.22; and

(d)   increase the administered item alongside Outcome 1 for IHPA by $3,687,430.00.

Note 1: The table has been amended by a determination under the Financial Management and Accountability Act 1997. That determination has amended only the actual appropriation items:

(a) for departmental items, the actual appropriation item is the “Total” amount in relation to an agency under the heading “Departmental”; and

(b) for administered items, the actual appropriation item is the amount set out opposite an Outcome of an agency under the heading “Administered”.

No other amounts in the table have been amended.

Note 2: Financial Management and Accountability Act 1997 Determination 2011/16 (Transfer of Functions from HEALTH to ANPHA) amended the amount alongside Outcome 1 under the heading “Administered” to transfer an amount to the Australian National Preventive Health Agency.

On 28 June 2011 the National Binge Drinking Strategy (NBDS) expansion function was transferred from the Department of Health and Ageing to the Australian National Preventive Health Agency.

Note 3: Financial Management and Accountability Act 1997 Determination 2012/01 (Transfer of functions from HEALTH to ANPHA) amended the amount alongside Outcome 1 under the heading “Administered” to transfer an amount to the Australian National Preventive Health Agency.

On 26 September 2011 the development and management of the National Healthy Workplace Employer Awards within the Healthy Workers Initiative, under the National Partnership Agreement was transferred to the Australian National Preventive Health Agency.

Note 4:    Financial Management and Accountability Act 1997 Determination 2012/08 (Transfer of functions from DPMC and HEALTH to NMHC) amended the amount alongside Outcome 11 under the heading “Administered” to transfer an amount to the National Mental Health Commission.

The National Mental Health Commission was established as an Executive Agency on 1 January 2012. Responsibility for the National Mental Health function was then transferred to the National Mental Health Commission from the Department of the Prime Minister and Cabinet. In addition, responsibility for development of the National Report Card has been transferred from HEALTH to NMHC.

Note 5: Financial Management and Accountability Act 1997 Determination 2012/20 — Section 32 (Transfer of Functions from HEALTH to IHPA) amended the amount alongside “Total, Department of Health and Ageing” under the heading “Departmental” and amended the amount alongside Outcome 13 under the heading “Administered” to transfer amounts to the new statutory authority, the Independent Hospital Pricing Authority, for which appropriations are transferred from the Department of Health and Ageing.
