Part 1 Preliminary

1. Name of instrument [Note 1]

This instrument is the Premium Support Scheme Amendment 2012.

2. Commencement

This instrument commences on 1 July 2012.

3. Amendment of the Premium Support Scheme 2004

The Schedule amends the Premium Support Scheme 2004.

Schedule - Amendments

[1] Part 4, subsection 14 (1)

substitute

(1) For an eligible member referred to in paragraph 12(1) (a), the PSS calculation is:

(a)                    for premium periods starting before 1 July 2012, 80% of the amount by which the member’s gross indemnity costs exceed the base amount; and

(b)                    for premium periods starting on or after 1 July 2012 and before 1 July 2013, 70% of the amount by which the member’s gross indemnity costs exceed the base amount; and

(c)                    for premium periods starting on or after 1 July 2013, 60% of the amount by which the member’s gross indemnity costs exceed the base amount.

(3) For a member referred to in subsection 12 (5), the base amount in subsection (1) is zero and the PSS calculation is:

(a)                        for premium periods starting before 1 July 2012, 80% of the member’s gross indemnity costs; and

(b)                       for premium periods starting on or after 1 July 2012 and before 1 July 2013, 70% of the member’s gross indemnity costs; and

(c)                        for premium periods starting on or after 1 July 2013, 60% of the member’s gross indemnity costs.

[3] Part 9, subsection 47 (2) and paragraph 47 (3) (a)

Omit ‘an employee authorised by the Medicare Australia CEO’, insert a Departmental employee (within the meaning of the Human Services (Medicare) Act 1973) authorised by the Chief Executive Medicare’.

[4] Part 9, subsection 47 (4)

Omit ‘An employee of Medicare Australia, insert A Departmental employee (within the meaning of the Human Services (Medicare) Act 1973)’.

[5] Further amendments – Medicare Australia CEO

The following provisions are amended by omitting each mention of ‘Medicare Australia CEO’ and inserting ‘Chief Executive Medicare’:
