PASS MARKS AND POOL MARKS IN RELATION TO APPLICATIONS FOR GENERAL SKILLED MIGRATION VISAS

(CLASSES VE, VC, VF, VB, SI, SN AND SP)

 

(Subsections 96(1) and 96(2))

 

I, CHRIS BOWEN, Minister for Immigration and Citizenship, acting under subsections 96(1) and 96(2) of the Migration Act 1958 (‘the Act’), hereby:

 

1. REVOKE Instrument Number IMMI 11/027 signed on 25 June 2011, specifying pass marks and pool marks in relation to applications for GSM skilled visas for the purposes of subsections 96(1) and 96(2) of the Act; AND

 

2.                   SPECIFY that, for the purposes of regulation 2.26AA of the Migration Regulations 1994 (‘the Regulations’), the pass and pool marks that appear in Part 1 of the Schedule to this Instrument apply; AND

 

3. SPECIFY that, for the purposes of regulation 2.26AB of the Regulations, the pass and pool marks that appear in Part 2 of the Schedule to the Instrument apply; AND

 

4. SPECIFY that, for the purposes of regulation 2.26AC of the Regulations, the pass and pool marks that appear in Part 3 of the Schedule to this Instrument apply.

 

This Instrument number, IMMI 12/017, commences on 1 July 2012, immediately after the commencement of the Migration Amendment Regulation 2012 (No. 2).

[NOTE 1: Subsection 96(1) of the Act provides that the Minister may, from time to time, by notice in the Gazette, specify, in relation to a class of visas, the pool mark for the purposes of the Act and the regulations.

NOTE 2: Subsection 96(2) of the Act provides that the Minister may, from time to time, by notice in the Gazette, specify, in relation to applications for visas of a particular class, the pass mark for the purposes of the Act and the regulations.

NOTE 3: Regulation 2.26AA of the Regulations specifies the prescribed qualifications and number of points for certain applications for General Skilled Migration visas.

NOTE 4: Regulation 2.26AB of the Regulations specifies the prescribed qualifications and number of points for other applications for General Skilled Migration visas.

NOTE 5: Regulation 2.26AC of the Regulations specifies the prescribed qualifications and number of points for certain other applications for General Skilled Migration visas.

NOTE 6: Subsection 56(1) of the Legislative Instruments Act 2003 provides that if the enabling legislation in relation to a legislative instrument as in force at any time before the commencing day required the text of the instrument, or particulars of its making, to be published in the Gazette, the requirement for publication in the Gazette is taken, in relation to any such instrument made on or after that day, to be satisfied if the instrument is registered.]
