Law Enforcement Integrity Commissioner Amendment Regulations 2010 (No. 1)1

I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Law Enforcement Integrity Commissioner Act 2006.

1 Name of Regulations

  These Regulations are the Law Enforcement Integrity Commissioner Amendment Regulations 2010 (No. 1).

2 Commencement

  These Regulations commence on 1 January 2011.

3 Amendment of Law Enforcement Integrity Commissioner Regulations 2006

  Schedule 1 amends the Law Enforcement Integrity Commissioner Regulations 2006.

ACBPS means the Australian Customs and Border Protection Service.

[3] After regulation 3

4 Head of government agency

  For the definition of head of a government agency in subsection 5 (1) of the Act, the head of the ACBPS is the CEO of the ACBPS appointed under section 5 of the Customs Administration Act 1985.

[4] After regulation 5

6 Law enforcement agency

  For paragraph (d) of the definition of law enforcement agency in subsection 5 (1) of the Act, the ACBPS is prescribed.             

8 Staff members

  For subsection 10 (4) of the Act, the following persons are staff members of the ACBPS:

 (a) the CEO of the ACBPS;

 (b) persons engaged under the Public Service Act 1999 to assist the CEO in accordance with section 15 of the Customs Administration Act 1985.

9 Secondees

  For paragraph 10 (5) (d) of the Act, a person is a secondee of the ACBPS if the person is:

 (a) not employed in the ACBPS; and

 (b) is authorised in writing by the CEO of the ACBPS to perform a function or functions of a person employed in the ACBPS.
