National Health (Eligible midwives) Determination 20101

National Health Act 1953

I, NICOLA ROXON, Minister for Health and Ageing, make this Determination under subsection 84AAE (3) of the National Health Act 1953.

1 Name of Determination

  This Determination is the National Health (Eligible midwives) Determination 2010.

2 Commencement

  This Determination commences on the later of the following:

 (a) 1 July 2010;

 (b) the day after it is registered.

3 Definitions

  In this Determination:

Act means the National Health Act 1953.

National Law means the Health Practitioner Regulation National Law set out in the Schedule to the Health Practitioner Regulation National Law Act 2009 (Qld).

Nursing and Midwifery Board means the Nursing and Midwifery Board of Australia established under section 31 of the National Law.

4 Eligibility requirements

  For subsection 84AAE (3) of the Act, a midwife must meet any registration standard for an eligible midwife developed by the Nursing and Midwifery Board for subsection 38 (2) of the National Law.

Note   Subsection 38 (2) deals with developing registration standards about matters for health practitioners.
