Amendments to the National Code 2007 made under subsection 33(1) of the Education Services for Overseas Students Act 2000

I, Julia Gillard, Minister for Education, pursuant to subsection 33(1) of the Education Services for Overseas Students Act 2000 (the ESOS Act), make the attached amendments to the National Code 2007 dated 7 March 2007 which were registered on the Federal Register of Legislative Instruments on 15 March 2007 (see F2007L00646).

Amendments to the National Code 2007 made under subsection 33(1) of the Education Services for Overseas Students Act 2000

(i) CITATION

This legislative instrument may be cited as Amendment No. 1 to the National Code 2007.

 (ii) AUTHORITY

This legislative instrument is made under subsection 33(1) of the Education Services for Overseas Students Act 2000.

 (iii) DATE OF EFFECT

This legislative instrument comes into effect 28 days after the day it is registered on the Federal Register of Legislative Instruments.

(iv) AMENDMENT

This legislative instrument amends the National Code 2007 registered on 15 March 2007 (see F2007L00646) and which commenced on 1 July 2007.

PURPOSE

• The purpose of the instrument is to amend the National Code 2007.

• The National Code 2007 is amended as follows:

AMENDMENTS

Part C. REGISTRATION ON CRICOS

Item 1 – at the end of paragraph 2

Insert “Note, that in 2010 providers are required to undertake a re-registration

process. A provider’s registration could be cancelled as a result of the re-registration process

under section 92A or section 92B of the ESOS Act.”

Item 2 – Paragraph 3

After the words “section 9” insert “and section 9A”.

Item 3 – Subparagraph f. of paragraph 6.1

After the words “section 9” insert “and section 9A”

Part D. STANDARDS FOR REGISTERED PROVIDERS

Item 4 – Section titled Staff, educational resources and premises (Standards 14 to 15) (Preamble, second paragraph)

Delete the words “required under section 9(6)” and substitute “set out in section 9B”

Item 5 – Paragraph 15.2

Delete the words “section 9(6)” and substitute “section 9B”
