I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Foreign States Immunities Act 1985.

1 Name of Regulations
These Regulations are the Foreign States Immunities Amendment Regulations 2009 (No. 1).
2 Commencement
These Regulations commence on the day after they are registered.
3 Amendment of Foreign States Immunities Regulations 1987
Schedule 1 amends the Foreign States Immunities Regulations 1987.

2A Emergency prevention and management — bushfires
Section 13 of the Act does not apply to acts or omissions of the United States of America (or a separate entity of the United States of America) if those acts or omissions are carried out:
(a) in the course of providing facilities or assistance to the Government of Australia, or the Government of an Australian State or Territory; and
(b) for the purpose of preparing for, preventing or managing bushfires in Australia.
