Permission  flying over a public gathering at the Wide Bay Australia International Air Show, Bundaberg

1 Duration

 This instrument:

(a) commences on 2 July 2009; and

(b) stops having effect at the end of 5 July 2009.

2 Application

  This instrument applies to operations:

(a) in connection with the Wide Bay Australian International Air Show 2009, organised by Richard King-Seam (the organiser) at Bundaberg Aerodrome, Queensland and commencing on 2 July 2009 (the Air Show); and

(b) engaged in by a person mentioned in Schedule 1 (a pilot) while acting as pilot in command of an aircraft mentioned in Schedule 1 (an aircraft).

3 Permission

 (1)A pilot may fly an aircraft over a public gathering at the Air Show below 1 500 feet above ground level in accordance with this permission.

 (2)For this instrument, the permission extends to flights by an aircraft on or after 2 July 2009 at Bundaberg Aerodrome, Queensland, in connection with the Air Show.

4 Conditions

 The permission is subject to the conditions mentioned in Schedule 2.

Schedule 1 Pilots and aircraft to which the permission applies

 This permission applies to:

(a) pilots of aeroplanes with a maximum take-off weight of less than 2 000 kg flying at less than 100 knots (an aircraft) and helicopters who are registered with Wide Bay Australian International Air Show for participation in operations involving flights over a public gathering at the Air Show; and

(b) aeroplanes with a maximum take-off weight of less than 2 000 kg that are flying at less than 100 knots and helicopters that are registered with Wide Bay Australian International Air Show for that purpose.

Note   All other pilots and aircraft operating in the Air Show must comply with the requirements of Civil Aviation Order 29.4 (CAO 29.4) as applicable to their operation.

Schedule 2 Conditions to which the permission is subject

 1In these conditions:

 flypast means wings-level flight by an aircraft (not in close formation) parallel to, or moving away from, the line of spectators, and with a rate of climb or descent no greater than 500 feet per minute.

 manoeuvres means any movement of an aircraft involving rolling, pitching or yawing.

 2 A pilot of an aircraft and a helicopter must comply with CAO 29.4, other than subparagraphs 4.2 (2) (a) and (b) (Manoeuvring Limitations).

 3 A pilot of an aircraft or a helicopter must not conduct a flypast within a horizontal distance from spectators of less than 100 metres.

 4 A pilot of an aircraft must not fly the aircraft with any rate of closure towards spectators within 150 metres minimum horizontal distance.

 5When taking-off:

(a) an aircraft, or a close formation of aircraft, must remain on or above the centreline of the designated runway until at a safe height; and

(b) the pilot or pilots may then manoeuvre away from the spectators to gain appropriate minimum distance from spectators.

 6When landing an aircraft, or a close formation of aircraft:

(a) the pilot or pilots must conduct conventional manoeuvres to gain the centreline of the designated runway; and

(b) an aircraft, or a close formation of aircraft, must remain aligned with the centreline of the runway until the aircraft has slowed down to a safe taxi speed.

 7 A pilot of any aircraft to which this permission applies must not conduct flight or flight manoeuvres within distances 100 metres from spectators.

 8 A pilot must not fly a helicopter with any rate of closure towards spectators within the following minimum horizontal distances:

(a) for a helicopter operating at an airspeed of up to 40 knots — 100 metres;

(b) for a helicopter operating at an airspeed between 40 knots and 100 knots — 150 metres;

(c) for a helicopter operating at an airspeed above 100 knots — 200 metres.

 9 A pilot of a helicopter must not conduct manoeuvres within the following minimum horizontal distances of spectators:

(a) for a helicopter with a maximum take-off weight up to and including 5 700 kg — within 150 metres;

(b) for a helicopter with a maximum take-off weight greater than 5 700 kg — within 200 metres.

 10The organiser must ensure that the 100 metre, 150 metre and 200 metre display lines are clearly marked on the display area so pilots can comply with these requirements.

 11If this marking is not possible, or if the marking is destroyed by weather or other conditions at the location, the pilots of aircraft in the Air Show must then comply with the requirements of CAO 29.4 as applicable to their operations.

 12The organiser must ensure that all pilots are briefed on the requirements and conditions of this permission prior to their participation in the Air Display or any associated practice session.
