Exemption — emergency locator transmitters
1 Duration
This instrument:
(a) commences on the day after it is registered; and
(b) stops having effect at the end of June 2009.
2 Application
This instrument applies to the pilot in command of an Australian aircraft that is:
(a) not an exempted aircraft; and
(b) a piston engine aeroplane or helicopter that has between 2 and 38 seats; and
(c) not fitted with an eligible emergency locator transmitter (ELT).
3 Exemption
The pilot in command of an Australian aircraft that is not an exempted aircraft is exempt from the requirements in regulation 252A of CAR 1988 not to begin a flight unless the aircraft is fitted with an approved ELT.
4 Conditions
The exemption is subject to the conditions mentioned in Schedule 1.
1 The pilot in command of the aircraft must lodge with Air Traffic Services (ATS) a comprehensive flight plan or flight note.
2 The pilot in command of the aircraft must nominate a SARTIME for each visual flight rules (V.F.R.) flight.
3 The pilot in command of the aircraft must advise ATS of a deviation from the flight plan or flight note.
4 The pilot in command of the aircraft must carry a 121.5 beacon provided the aircraft is fitted with HF and a VHF 121.5MHz ELT.
