Exemption take-off weight limitations

1 Duration

 This instrument:

(a) commences on the day after it is registered; and

(b) stops having effect at the end of 1 April 2009.

2 Application

 This instrument applies to the pilot in command of an aeroplane mentioned in Schedule 1 (the aeroplane) engaged in firefighting and agricultural operations.

3 Exemption

 A pilot in command of an aeroplane engaged in firefighting and agricultural operations is exempt from the take-off weight limitations in regulation 137.190 of CASR 1998.

4 Conditions

 The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 2 Conditions

 1  A pilot in command of an aeroplane must not commence a take-off if the aeroplanes gross weight exceeds 6 600 kg.

 2  The pilot in command of an aeroplane must comply with the operational limitations and procedures for operations above 5 300 kg in the Auto Avia Design Flight Manual Supplement 207/403/FMS titled PZL M18, M18 Dromader Restricted Category STC-MTOW Increase (Flight Manual Supplement).

 3  The pilot in command must ensure that the aeroplane is within its service life.

Note   For the purpose of calculating the service life, the recorded flight hours must be adjusted using the factors specified in section 2.12 Service Limitation of the Flight Manual Supplement. The calculations must take into account overweight operations of the aircraft prior to the issue of this instrument.

 4  A pilot in command of an aeroplane must have his or her experience assessed by Anthony David Travers-Jones, Aviation Reference Number (ARN) 166630, of Rebel Ag Pty Ltd, trading as Hillston Air Work and Warren Air Work, ARN 900527, as being competent to conduct operations with the aeroplane at weights above 5 300 kg.
