1 Name of Standard

  This Standard is the Radiocommunications (Devices Used in the Inshore Boating Radio Services Band) Standard 2008.

2 Commencement

  This Standard commences on the day after it is registered.

3 Definitions

  In this Standard:

Act means the Radiocommunications Act 1992.

AS 4367:2007 means the standard AS 4367:2007 (Radiocommunications equipment used in the inshore boating radio services band) published by Standards Australia, as in force from time to time.

IBRS equipment means a radiocommunications device that:

 (a) can operate on a carrier frequency specified for an inshore boating radio service in Australia; or

 (b) was designed or intended to provide a substantially similar service to an inshore boating radio service on a carrier frequency below 30 MHz specified for such a service outside Australia.

model, in relation to IBRS equipment, means a version of the device that has a particular design and identifying number.

significant event means an event at a specified location or locations, notified, with the approval of the Chairman of ACMA, on the website http://www.acma.gov.au.

  The Radiocommunications Standard (Radiocommunications Devices Used in the Inshore Boating Radio Services Band) No. 1 of 1996 is revoked.

5 Application

 (1) This Standard applies to IBRS equipment, other than equipment imported into, and used in, Australia in the circumstances mentioned in subsection (2).

 (2) This Standard does not apply to IBRS equipment if:

 (a) the equipment is imported solely for use in connection with a significant event; and

 (b) if required to be tested or inspected by ACMA before it is used in Australia the equipment meets any testing or inspection requirements; and

 (c) if conditions or requirements are imposed by ACMA on the use of the equipment in Australia the equipment meets those conditions or requirements; and

 (d) the equipment is used in Australia only:

 (i) at the location of the significant event; and

 (ii) for the duration of the significant event.

6 Standard for performance

  For paragraph 162 (1) (a) of the Act, the standard for performance of IBRS equipment is AS 4367:2007, other than clauses 1, 2.11 and 4.1 of that Standard.

7 Compliance with this Standard — devices complying with former Standard

 (1) This section has effect despite the revocation of Radiocommunications Standard (Radiocommunications Devices Used in the Inshore Boating Radio Services Band) No. 1 of 1996 (the former Standard).

 (2) If a particular model of IBRS equipment complied with the former standard before the commencement of this Standard, any IBRS equipment of that model is taken to comply with this Standard, regardless of when the equipment was manufactured, imported, altered or modified.

8 Compliance with this Standard after amendment of the standard for performance

 (1) This section applies to IBRS equipment (other than equipment mentioned in section 7) if the standard for performance described in section 6 is amended.

 (2) IBRS equipment that is manufactured, imported, altered or modified within 1 year after the date of effect of the amendment (the amendment date) is taken to comply with the standard for performance, as amended, if the equipment complies with that standard as in force immediately before the amendment date.

 (3) IBRS equipment that is manufactured, imported, altered or modified 1 year or more after the amendment date must comply with the standard for performance, as amended.
