Exemption  from take-off minima inside Australian territory

1 Duration

 This instrument:

(a) commences on the day after it is registered; and

(b) stops having effect at the end of 31 May 2009.

2 Application

 This instrument applies to the aircraft mentioned in Schedule 1 (the aircraft) only when operated:

(a) by Emirates of Dubai, United Arab Emirates, under foreign Air Operator’s Certificate number 539440 (the operator); and

(b) in take-off operations inside Australian territory; and

(c) at the following airports:

 (i) Sydney International Airport;

 (ii) Melbourne International Airport.

3 Exemption

 The aircraft are exempt from compliance with subregulation 257 (3) of CAR 1988 in relation to the standard take-off minima determined by CASA under subregulation 257 (1) of CAR 1988 and set out in AIP En Route 1.5, section 4.3.

4 Conditions

 The exemption is subject to the conditions mentioned in Schedule 2.

Schedule 2 Conditions

1 Alternative meteorological minima

 (1) The meteorological minima for take-off must be runway visibility range (RVR) of at least 350 metres.

 (2) For subclause (1), the RVR must be assessed along the runway at the touchdown zone and at the mid-point.

 (3) Visibility measurements from the touchdown and mid-point zones of the runway must be available and must be used.

2 Air traffic control

  The aircraft may only take-off if:

(a) Air Traffic Control (ATC) services are provided and are available at the time of the operation; and

(b) ATC low visibility procedures have been established at the aerodrome.

3 RVR  lighting requirements and turning

 (1) If RVR is more than 450 metres but less than 500 metres, the aircraft may only take off with runway edge lighting (with light spacing of not more than 60 metres) (REL 60) switched on and a defined centreline visible on the runway.

 (2) If RVR is more than 400 metres but less than 450 metres, the aircraft may only take off with both REL 60 and runway centreline lighting (RCL) switched on.

 (3) If RVR is at least 350 metres but less than 400 metres, the aircraft may only take off with both REL 60 and RCL with light spacing of not more than 30 metres, switched on.

 (4) If RVR is less than 500 metres, the aircraft must not take off where, for allengine or engine-out take-offs, the runway would require the aircraft to turn:

(a) more than 15° at either runway head; or

(b) below 200 feet.

4 Approval for operations and procedures

 (1) The operator must continue to be approved by the General Civil Aviation Authority of the United Arab Emirates to conduct low visibility take-off operations with low visibility of 350 metres or less.

 (2) Each airport must be listed on the operator’s Australian foreign aircraft Air Operator’s Certificate.

 (3) Detailed briefing material about low visibility take-off operations from each airport, must be:

(a) included in the operator’s operations manual; and

(b) not inconsistent with this instrument; and

(c) observed in the course of the operations at the airport.

 (4) A copy of this instrument must be kept in the operator’s operations manual with:

(a) the list of runways the operator uses for low visibility take-off operations; and

(b) their respective minimum take-off RVR.
