The Repatriation Commission, pursuant to subsection 90(4) of the Veterans’ Entitlements Act 1986, varies the Treatment Principles (Instrument No. R8 of 2004) in accordance with the Schedule.

This Instrument is to be taken to have commenced on 1 November 2007.
[3] Variation of the Treatment Principles
The Schedule varies the Treatment Principles.
[4] Paragraph 1.4.1 (definition of “Notes for Providers of Optometric Services/Dispensers of Optical Appliances”)
After this definition, insert:
“nursing-home-type care” means the treatment described in paragraph 9.3 of the Principles.
[5] Paragraph 1.4.1 (definition of “residential care amount”)
After this definition, insert:
“residential care facility” means a facility in which residential care is provided to a person.
[6] Paragraph 1.4.1 (definition of “revoked Treatment Principles”)
After this definition, insert:
“Rozelle Hospital” means the institution that was in operation and known as Rozelle Hospital, corner Glover Street and Balmain Road in the Repatriation Hastings (H) Ward immediately before 1 November 2007.
[7] Paragraph 1.4.1 (definition of “veteran”)
After this definition, insert:
“veteran has been transferred from Rozelle Hospital” means a veteran who was a patient receiving nursing-home-type care at Rozelle Hospital on or after 1 November 2007.

Insert:
10.5A Part-Payment of residential care amount for veterans transferred from Rozelle Hospital
10.5A.1 Where a veteran has been transferred from Rozelle Hospital to a residential care facility the Commission shall accept financial responsibility for that part of the veteran’s residential care amount that exceeds the residential care amount the veteran would have paid had the veteran remained in nursing-home-type care at Rozelle Hospital.
