I, PHILIP MICHAEL JEFFERY, Governor‑General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Building and Construction Industry Improvement Amendment Act 2005.

1 Name of Regulations
These Regulations are the Building and Construction Industry Improvement Amendment Regulations 2007 (No. 2).
2 Commencement
These Regulations commence on the day after they are registered.
3 Amendment of Building and Construction Industry Improvement Regulations 2005
Schedule 1 amends the Building and Construction Industry Improvement Regulations 2005.
Schedule 1 Amendments
(regulation 3)
[1] Subregulation 4.1 (2)
substitute
(2) It is a function to record information about the occupational health and safety performance of:
(a) an accredited person; and
(b) a person who has applied to be accredited under the Building and Construction Industry Improvement (Accreditation Scheme) Regulations 2005.
[2] Subregulation 8.1A (2)
substitute
(2) Protected information may be recorded and disclosed for the purpose of assessing the suitability of:
(a) an accredited person; or
(b) any person who has ever applied to be accredited under the Building and Construction Industry Improvement (Accreditation Scheme) Regulations 2005;
to undertake Commonwealth building work.
