Exemption — carriage of passengers on training flight

1 Duration

 This instrument:

(a) commences on the day after it is registered; and

(b) stops having effect at the end of 30 September 2007.

2 Application

 This instrument applies to the conduct of a training flight in an aeroplane operated by Brindabella Airlines Pty Ltd, Aviation Reference Number 558662 (the operator).

3 Exemption — relating to carriage of passengers

 (1)This instrument exempts the pilot in command of the aeroplane from compliance with subregulation 249 (1) of CAR 1988.

 (2)The exemption only applies to the extent mentioned in Schedule 1.

4 Conditions

 The exemption is subject to the conditions in Schedule 2.

Schedule 1 Extent of exemption

  In spite of paragraph 249 (1) (a) of CAR 1988, the aeroplane may carry a passenger while the pilot in command gives flying training to a student pilot who has not passed a general flying progress flight test.

Schedule 2 Conditions

 1 The exemption only applies to 1 training flight conducted by a flight instructor qualified to give flying training in the aircraft.

 2 The passenger carried must be a journalist employed by, or contracted to, the Australian Broadcasting Corporation.

 3 The student pilot must be a person suffering from lower limb disabilities and using an approved hand control for rudder operation.

 4 The operator must ensure that the passenger is made aware of the additional risks that an aerial work training flight may impose compared with a charter or regular public transport operation and the passenger must give informed consent, in writing, to participate in the activity.

 5 Flight manoeuvres must be limited to those permitted in the aircraft flight manual or pilot operating handbook for the aircraft being flown for operations in the normal flight category.

 6 Practice emergency procedures or low flying practice are not permitted.

 7 The pilot in command must ensure that the passenger minimises movement, noise and other distractions that might interfere with the communication between the instructor and the student.

 8 The pilot in command must ensure that any video or audio equipment carried by the passenger is used in such a manner that it does not present a hazard to the occupants of the aircraft.
