Migration Agents Regulations 1998

PRESCRIBED COURSES FOR APPLICANTS FOR REGISTRATION AS A MIGRATION AGENT

 (REGULATION 5(1)(a))

I, ANDREW ROBB, Parliamentary Secretary to the Minister for Immigration and Multicultural Affairs, acting under paragraph 5(1)(a) of the Migration Agents Regulations 1998 ("the Regulations"):

 

  1. REVOKE the Instrument “Prescribed Course Notice”, signed on 11 May 2006 by an authorised officer for the Migration Agents Registration Authority, that approves courses as prescribed courses for the purposes of section 289A(c) of the Migration Act 1958 (‘the Act’); and

 

2. SPECIFY the following courses as a prescribed course for the purposes of paragraph 5(1)(a) of the Regulations:

 

(a)                Graduate Certificate in Australian Migration Law and Practice at The Australian National University, Griffith University, Murdoch University and Victoria University; and

(b)               A formal course of study or self directed study in migration law and procedure completed before 15 July 2006.

 

This Instrument, IMMI 06/056, commences on 1 October 2006.

[NOTE 1:   Regulation 5(1)(a) provides that the Minister may specify in an instrument in writing a prescribed course for the purposes of paragraph 289A(c) of the Act.

NOTE 2:  Paragraph 289A(c) of the Act provides that if an applicant has never been registered or is applying to be registered more than 12 months after the end of his or her previous registration, the applicant must not be registered unless the Migration Agents Registration Authority is satisfied that the applicant has completed a prescribed course within the prescribed period and has passed a prescribed exam within the prescribed period.]
