1 Purpose and power

1.1 Purpose

 This Part of Marine Orders:

(a) gives effect to those parts of Chapter I of SOLAS, which deals with the survey and certification of ships, to which specific effect is not given in the Navigation Act; and

(b) makes provision generally for and in relation to the survey, inspection and certification of ships.

Note   The current text of Chapter I is to be found in the SOLAS Consolidated Edition 2009.

1.2  Power

1.2.1 Section 191 of the Navigation Act provides for regulations to make provision for or in relation to giving effect to SOLAS.

1.2.2 Divisions 1, 2 and 2B of Part IV of the Navigation Act provide for regulations to be made relating to the survey, inspection and certification of ships.

1.2.3 Subsection 425 (1) of the Navigation Act provides for regulations to be made prescribing matters required or permitted to be prescribed or which are necessary or convenient to be prescribed for carrying out or giving effect to the Act.

1.2.4 Subsection 425 (1AA) of the Navigation Act provides that AMSA may make orders with respect to any matter for or in relation to which provision may be made by regulation.

2 Definitions of words and phrases used in this Part

AMSA means the Australian Maritime Safety Authority established by the Australian Maritime Safety Authority Act 1990;

anniversary date means the day and the month of each year which will correspond to the date of expiry of the relevant certificate;

cargo ship does not include a fishing vessel;

General Manager means the person occupying the position of General Manager, Maritime Operations Division, in AMSA;

Manager, Ship Inspections means the person occupying the position of Manager, Ship Inspections, in AMSA or, in respect of any particular purpose under this Part, a suitably qualified person authorised by the Manager, Ship Inspections, for that purpose;

Navigation Act means the Navigation Act 1912;

SOLAS means the Safety Convention as defined in the Navigation Act;

survey authority means a corporation or association for the survey of shipping, approved by AMSA, in writing, for the purposes of the Navigation Act;

surveyor means:

(a) a person appointed as a surveyor under section 190 of the Navigation Act; or

(b) a person employed as a surveyor by a survey authority as defined in the Navigation Act;

USL Class 1A and 2A include international operations where the ship is not subject to SOLAS;

USL Class 3A includes international operations.

3 Interpretation

3.1 Unless otherwise provided, terms and abbreviations which are used in this Part and which are defined in SOLAS have the meanings as defined in SOLAS.

3.2 A reference in SOLAS to the Administration is to be read as a reference to the Manager, Ship Inspections.

3.3 In this Part, a reference to the date on which a ship was constructed means the date on which not less than 50 tonnes or one per cent of the proposed total mass of the structural material of the ship, whichever is the less, has been assembled.

3.4 In this Part:

(a) headings and subheadings are part of the Part;

(b) the Appendix is part of the Part; and

(c) a note is not part of the Part, but may provide additional information or guidance in applying the Part.

4 Application

4.1 This Part applies whenever a ship is surveyed, or is liable to be surveyed, under the Navigation Act.

4.2 This Part does not apply to a nuclear ship to the extent that it is inconsistent with Chapter VIII of SOLAS.

4.3 The survey requirements of this Part apply to a ship not propelled by mechanical means as though it were being surveyed for the issue, renewal or endorsement of a certificate as a steamship of an equivalent kind.

5 Review of decisions

5.1 Internal review

5.1.1 If the Manager, Ship Inspections, makes a decision under this Part, a person affected by the decision may, within 3 months of the date of notification of the decision or such longer period as determined by the General Manager, apply to the General Manager for review of that decision.

5.1.2 An application for internal review under 5.1.1 must be made in writing to the General Manager and must be accompanied by such information as the General Manager requires to enable the decision to be properly reviewed.

5.1.3 The General Manager may:

(a) affirm the original decision by the Manager, Ship Inspections; or

(b) make any decision that could be made by the Manager, Ship Inspections, in accordance with this Part.

5.1.4 The General Manager must notify his or her decision in writing to the applicant within 28 days of receiving the application for internal review.

5.2  Review by the AAT

5.2.1 Application may be made to the Administrative Appeals Tribunal for review of a decision by the General Manager under 5.1.3.

5.2.2 The notice under 5.1.4 must include:

(a) a statement to the effect that, if the person is dissatisfied with the decision, application may, subject to the Administrative Appeals Tribunal Act 1975, be made to the Administrative Appeals Tribunal for review of the decision; and

(b) a statement to the effect that the person may request a statement under section 28 of that Act.

5.2.3 Failure to comply with 5.2.2 in relation to a decision does not affect the validity of that decision.

6 Alterations etc. of ships

 For the purposes of subsection 190A (1) of the Navigation Act:

(a) the prescribed person is:

(i) if the ship is in a port where there is an AMSA survey office any surveyor employed by AMSA at that office;

(ii) if the ship is in a port where there is no AMSA survey office — the AMSA Area Manager in charge of surveys for the State or Territory in which that port is situated;

(iii) if the ship is in a port outside Australia, or at sea the Manager, Ship Inspections; and

(b) the prescribed form is Form MO-31/13 in the Appendix.

Note 2   A radio message transmitted by INMARSAT-C or HF DSC, addressed to and received by the Manager, Ship Inspections, through Rescue Coordination Centre (RCC) Australia, is considered to be written notice.

7 Surveys of passenger ships

(SOLAS I/7)

7.1 Survey requirements

 A passenger ship must be surveyed in accordance with Regulation 7 of Chapter I of SOLAS and with such requirements of the Navigation Act and Marine Orders as are applicable to the ship.

7.2 Inwater inspections

 The Manager, Ship Inspections, may permit alternate inspections of the outside of a ships bottom to be carried out while the ship is afloat, subject to such conditions as the Manager, Ship Inspections, stipulates.

Note   The Manager, Ship Inspections, will only permit inspections of the outside of a ships bottom to be carried out while the ship is afloat if the surveyor is using video equipment operated in-water by a diving contractor with underwater hull inspection skills and experience acceptable to the Manager, Ship Inspections.  The underwater hull must be marked in such a manner as to enable the location of the diver and underwater camera to be readily identified, by frame and strake.  The markings must be verified at the intervening dry dockings or slippings and found to be satisfactory.

7.3 Testing of boilers, pipes etc.

 Main and auxiliary boilers, connections, steam pipes, high pressure receivers, and fuel tanks for internal combustion engines must be tested, hydraulically or otherwise, before entering service and subsequently, according to test procedures and at intervals as specified by the Manager, Ship Inspections, or survey authority.

Note   The Manager, Ship Inspections, will specify the appropriate procedures for an unclassed ship on application by the owner.

8 Surveys of lifesaving appliances and other equipment of cargo ships

(SOLAS I/8)

8.1  Survey requirements

 The lifesaving appliances and other equipment of a cargo ship must be surveyed in accordance with Regulation 8 of Chapter I of SOLAS and with such requirements of the Navigation Act and Marine Orders as are applicable to the ship.

8.2  Endorsement of certificates

 In addition to the requirements of Regulation 8 (c) of Chapter I of SOLAS, the periodical and annual surveys referred to in Regulation 8 must be endorsed on the Certificate of Survey for a Cargo Ship or Cargo Ship Safety Certificate.

9 Surveys of radio installations of cargo ships

(SOLAS I/9)

9.1 Survey requirements

 The radio installations of cargo ships, including those used in lifesaving appliances, must be surveyed in accordance with Regulation 9 of Chapter I of SOLAS and with such requirements of the Navigation Act and Marine Orders as are applicable to the ship.

9.2 Endorsement of certificates

 In addition to the requirements of Regulation 9 (c) of Chapter I of SOLAS, the annual periodical surveys referred to in Regulation 9 must be endorsed on the Certificate of Survey for a Cargo Ship or Cargo Ship Safety Certificate.

10 Surveys of structure, machinery and equipment of cargo ships

(SOLAS I/10)

10.1  Survey requirements

10.1.1 The structure, machinery and equipment of a cargo ship (other than items in respect of which a Certificate of Survey for a Cargo Ship, a Cargo Ship Safety Certificate, a Cargo Ship Safety Equipment Certificate and a Cargo Ship Safety Radio Certificate are issued) must be surveyed in accordance with Regulation 10 of Chapter I of SOLAS and with such requirements of the Navigation Act and Marine Orders as are applicable to the ship.

10.1.2 The intermediate and annual surveys required by Regulation 10 (a) (iii) of Chapter I of SOLAS are also required in respect of a Certificate of Survey for a Cargo Ship and a Cargo Ship Safety Certificate.

10.1.3 The Manager, Ship Inspections, may permit alternate inspections of the outside of a ships bottom to be carried out while the ship is afloat, subject to such conditions as the Manager, Ship Inspections, stipulates.

10.2  Endorsement of certificates

 In addition to the requirements of Regulation 10 (c) of Chapter I of SOLAS, the intermediate and annual surveys and the inspections of the outside of the ships bottom referred to in Regulation 10 must be endorsed on the Certificate of Survey for a Cargo Ship or Cargo Ship Safety Certificate.

11 Surveys of structure, machinery and equipment of fishing vessels

11.1  Initial survey

 A fishing vessel is subject to an initial survey before the vessel is put into service or before the certificate required by the Navigation Act is issued for the first time, which must include a complete survey of its structure, stability, machinery, arrangements and material, including the outside of the vessels hull and the inside and outside of the boilers and equipment.  This survey must be such as to ensure that the arrangements, material, and scantlings of the structure, boilers, and other pressure vessels and their appurtenances, main and auxiliary machinery, electrical installations, radio installations including those used in lifesaving appliances, fire protection, fire safety systems and appliances, lifesaving appliances and arrangements, shipborne navigational equipment, nautical publications and other equipment fully comply with the requirements of the Navigation Act and Marine Orders.  The survey must also be such as to ensure that the workmanship of all parts of the vessel and its equipment is in all respects satisfactory and that the vessel is provided with the lights, means of making sound signals and distress signals required by the Navigation Act and Marine Orders.  Where pilot transfer arrangements are carried these shall also be surveyed to ensure that they are in a safe working condition and comply with the relevant requirements of the Navigation Act and Marine Orders.

11.2  Periodical surveys

11.2.1 A fishing vessel in respect of which a Certificate of Survey as a Fishing Vessel has been issued is subject to a renewal survey at intervals not exceeding 5 years after the completion of the initial survey, including an inspection of the outside of the vessels bottom in dry dock or on a slip, and a periodical survey within three months before or after the second or third anniversary date of the Certificate of Survey, which will take the place of one of the intermediate surveys referred to in 11.3.

11.2.2 Periodical surveys must be such as to ensure that the appropriate items referred to in 11.1 fully comply with the applicable requirements of the Navigation Act and Marine Orders, that the equipment is in good working order and that the stability information is readily available on board.

11.3  Intermediate surveys

 In addition to the periodical surveys required by 11.2, a fishing vessel is subject to annual intermediate surveys of its structure, machinery and equipment.

Note   The intermediate surveys are intended, among other things, to ensure that alterations have not been made that would adversely affect the safety of the vessel or the crew.

11.4 Endorsement of certificates

 Periodical surveys, as specified in 11.2.1, and intermediate surveys, as specified in 11.3, must be endorsed on the appropriate certificate.

12 Particular kinds of ships

12.1 If a ship is to be surveyed for the issue, renewal or endorsement of:

(a) a certificate of fitness under Marine Orders Part 17 (Liquefied Gas Carriers and Chemical Tankers); or

(b) a mobile off-shore drilling unit safety certificate under Marine Orders Part 47 (Offshore Industry Mobile Units); or

(c) a DSC Construction and Equipment Certificate under Marine Orders Part 49 (High Speed Craft); or

(d) an HSC Safety Certificate under Marine Orders Part 49 (High Speed Craft);

(e) a Special Purpose Ship Safety Certificate under Marine Orders Part 50 (Special Purpose Ships); or

(f) an Australian Certificate for the Carriage of Livestock under Marine Orders Part 43 (Cargo & cargo handling livestock);

 it must comply with this Part except to the extent that a provision of this Part is inconsistent with a provision of a Part of Marine Orders referred to above and applicable to that ship.

12.2 If a ship is to be surveyed for the issue, renewal or endorsement of an International Certificate of Fitness for the Carriage of INF cargo, as required by Regulation 16.1 of Chapter VII of SOLAS, it must comply with this Part except to the extent that a provision of this Part is inconsistent with a provision of the INF Code, as defined in Marine Orders, Part 41 (Carriage of Dangerous Goods).

13 Maintenance of condition after survey

(SOLAS I/6 (c) & I/11)

13.1  Maintenance of condition

13.1.1 The condition of the ship and its equipment must be maintained to conform with the Navigation Act, Marine Orders and Regulation 11 of Chapter I of SOLAS to ensure that the ship in all respects remains fit to proceed to sea without danger to the ship or persons on board.

13.1.2 When a surveyor determines that the condition of a ship or any of its equipment does not comply with the Navigation Act, Marine Orders or Regulation 11 of Chapter I of SOLAS such that the ship is not fit to proceed to sea without danger to the ship or persons on board, the surveyor must inform the owner, master or agent of the ship of the deficiency.

Note   Section 210 of the Navigation Act provides for the detention of a ship that is not seaworthy. In the case of an Australian ship, AMSA may cancel the certificates of a ship that does not comply with the Navigation Act, Marine Orders and Regulation 11 of Chapter I of SOLAS. The Manager, Ship Inspections, has been authorised by AMSA to exercise this power on its behalf.

13.2 Reports under section 268 of the Navigation Act

13.2.1 For section 268 of the Navigation Act, the staff member of AMSA prescribed to receive a report under that section is the General Manager.

13.2.1A For subsection 268(1E) of the Navigation Act, a report is in the required form if the report sets out:

(a) the particulars of the accident, damage, defect or event (as the case may be) and the time, place and circumstances of its occurrence;

(b) the particulars of the ship, its owner and its crew; and

(c) the particulars of the voyage during which the accident, damage, defect or event occurred

in a manner that complies with Form MO-31/14 (Incident Alert form – also known as form AMSA 18) or Form MO31/15 (Incident Report form – also known as form AMSA 19) in the Appendix.

13.2.1B A master of a ship must send to the General Manager:

(a) an Incident Alert form no later than 4 hours after the incident occurred; and

(b) an Incident Report form no later than 72 hours after the incident occurred.

13.2.2 If a report has been made under section 268 of the Navigation Act, the Manager, Ship Inspections, must initiate such investigations as are needed to determine if a survey of the ship is necessary.

Note   A report under section 268 of the Navigation Act is to be made to the General Manager through Rescue Coordination Centre (RCC) Australia.  If a master is unable to access the appropriate AMSA Form, AMSA will accept another document if that document sets out the information mentioned in the appropriate AMSA Form.

If the ship is in a port outside Australia, the master must, in addition to reporting the incident to the General Manager, report the incident to the appropriate authority of the country in which the port is situated.

If one or more of the certificates relating to a ship in respect of which a report has been made under section 268 of the Navigation Act were issued by a survey authority, a report in similar terms must also be made to that survey authority.

14 Duration of certificates

14.1  Duration of certificates

14.1.1 For the purposes of subsection 206N (2) of the Navigation Act the period for which a certificate specified in column 1 of Table 1 remains in force, unless extended in accordance with 14.3, must not exceed the period specified in column 3.

14.1.2 For the purposes of subsection 195 (1) of the Navigation Act the period for which a certificate specified in column 2 of Table 1 remains in force, unless extended in accordance with 14.3, must not exceed the period prescribed in column 3.

14.2 Commencement of renewal period

 If an existing certificate is being renewed, the period in column 3 of Table 1 commences:

(a) if the renewal survey is completed on, or within three months before, the expiry date of the existing certificate from the expiry date of the existing certificate; or

(b) if the renewal survey is completed after the expiry date of the existing certificate from the expiry date of the existing certificate; or

(c) if the renewal survey is completed more than three months before the expiry date of the existing certificate from the date of completion of the renewal survey.

14.3 Extension of validity

14.3.1 If a certificate is issued for a period of less than the maximum period specified in Table 1, the  Manager, Ship Inspections, may extend the validity of the certificate beyond the expiry date to the maximum period, provided that the surveys referred to in 8, 9 and 10 applicable when a certificate is issued for a period exceeding one year are carried out as appropriate.

14.3.2 If a renewal survey has been completed and a new certificate cannot be issued or placed on board the ship before the expiry date of the existing cer­tificate, the Manager, Ship Inspections, or survey authority, as appropriate, must endorse the existing certificate and such a certificate is to be accepted as valid for a further period which must not exceed 5 months from the expiry date.

14.3.3 If an Australian ship (other than a fishing vessel) at the time when a certificate expires is not in a port in which it is to be surveyed, the Manager, Ship Inspections, or a consul or other diplomatic representative of Australia may extend the period of validity of the certificate but this extension is to be granted only for the purpose of allowing the ship to complete its voyage to the port in which it is to be surveyed, and then only in cases where it appears proper and reasonable to do so. No certificate is to be extended for a period longer than three months, and a ship to which an extension is granted must not, on its arrival in the port in which it is to be surveyed, be entitled by virtue of such extension to leave that port without having a new certificate.  When the renewal survey is completed, the period in column 3 of Table 1 commences from the expiry date of the existing certificate before the extension was granted.

14.3.4 A certificate that has been issued to a fishing vessel, or a ship (other than a fishing vessel) engaged on short voyages, and that has not been extended under 14.3.1, 14.3.3 or 14.3.5 may be extended by the Manager, Ship Inspections, or a consul or other diplomatic representative of Australia for a period of grace of up to one month from the date of expiry stated on it. When the renewal survey is completed, the period in column 3 of Table 1 commences from the expiry date of the existing certificate before the extension was granted.

14.3.5 If an Australian-registered fishing vessel is not in an Australian port when its certificate expires or ceases, the Manager, Ship Inspections, or a consul or other diplomatic representative of Australia may extend the period of validity of the certificate but this extension is to be granted only for the purpose of allowing the vessel to complete its voyage to a port in Australia or to the port in which it is to be surveyed, and then only in cases where it appears proper and reasonable to do so.  No certificate is to be extended for a period longer than three months, and a vessel to which such extension is granted must not, on its first arrival in an Australian port or the port in which it is to be surveyed, be entitled by virtue of such extension to leave such port without having obtained a new certificate.

14.3.6 In special circumstances, as determined by the Manager, Ship Inspections, a new certificate need not be dated from the date of expiry of the existing certificate as required by 14.2 (b), 14.3.3 or 14.3.4.  In these special circumstances the period in column 3 of Table 1 commences from the date of completion of the renewal survey.

Note   Special circumstances might include a situation where a ship is laid up at the time the survey is due and remains laid up for a period of 6 months or more.

14.4 Surveys completed before certificate expiry

 If an annual, intermediate or periodical survey is completed before the period specified in this Part, then:

(a) the anniversary date shown on the relevant certificate is to be amended by endorsement to a date which must not be more than three months later than the date on which the survey was completed;

(b) the subsequent annual, intermediate or periodical survey required by this Part must be completed at the intervals prescribed by this Part using the new anniversary date;

(c) the expiry date may remain unchanged provided one or more annual, intermediate or periodical surveys, as appropriate, are carried out so that the maximum intervals between the surveys specified in this Part are not exceeded.

14.5 Certificate ceasing to be valid

 A certificate ceases to be valid in any of the following cases:

(a) if the relevant surveys and inspections are not completed within the periods specified in this Part;

(b) if the certificate is not endorsed in accordance with this Part;

(c) upon transfer of the ship to the Australian flag.

Note   A new certificate will not be issued until AMSA or a survey authority, as appropriate, is fully satisfied that the ship is in compliance with the requirements of the Navigation Act and Marine Orders.

14.6 Issue, endorsement etc of certificates

 Except where specifically provided for in the Navigation Act or a Part of Marine Orders, a certificate is to be issued, endorsed, extended or otherwise dealt with by a surveyor.

15 Form of certificates

For the purposes of Divisions 2 and 2B of Part IV of the Navigation Act, the prescribed form of a certificate specified in column 1 of Table 2 is the form in the Appendix that is specified in column 2 of Table 2.

16 Application for survey or extension

16.1 Application for survey

16.1.1 Application for a survey must, unless made to a survey authority, be made by, or on behalf of, the owner in accordance with Form MO-31/1 in the Appendix.

16.1.2 An application for survey must be accompanied by such plans, information and data as are needed by the Manager, Ship Inspections, to ensure that the ship complies, or will comply, with the requirements of the relevant Marine Orders.

16.1.3 An application for a survey of a ship for the issue of a certificate of fitness referred to in 12.1 (a) must be accompanied by such information as the Manager, Ship Inspections, may require.

Note for provision 16.1.1   The application should be sent to the survey office at or nearest the port at which the survey is required.  If a survey is required at a port outside Australia, the application should be sent to the Manager, Ship Inspections.

16.2 Application for extension

 An application for extension of a certificate under section 195 or 206P of the Navigation Act must be in writing.

17 Surveyors declaration

A declaration by a surveyor under subsection 194 (2) of the Navigation Act must be in accordance with Form MO-31/2 in the Appendix.

18 Exemption from survey

18.1 A ship in respect of which there is in force a valid SOLAS certificate is exempt from survey under subsection 193 (1) of the Navigation Act in regard to those parts of the ship to which the certificate relates.

18.2 A cargo ship:

(a) that is registered in a country other than Australia and is not a Safety Convention ship; or

(b) that is registered in Australia and is less than 500 gross tonnage;

 in respect of which there is in force a valid classification or equivalent certificate, is exempt from survey under subsection 193(1) of the Navigation Act in respect of its hull, machinery, anchors and anchor cables.

18.2A In 18.2, equivalent certificate means a certificate determined in writing by the Manager, Ship Inspections, to be an equivalent certificate for the purposes of that provision.

18.3 Nothing in this Part affects the liability of a ship to survey or inspection under section 204 or section 210 of the Navigation Act.

19 Transitional

Provided that the relevant annual and intermediate surveys are undertaken in accordance with this Part, the Manager, Ship Inspections, may extend the validity of a Cargo Ship Safety Equipment Certificate, an Equipment Certificate, a Cargo Ship Safety Radio Certificate or a Radio Certificate for the purpose of aligning the expiry date with that of the ships Cargo Ship Safety Construction Certificate, Load Line Certificate or classification certificate, as appropriate.
