Variation to Licence Area Plan for Canberra (Radio) – No 1 of 2006

Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Canberra (Radio) determined on 17 June 1999 (the principal instrument) in the manner set out below:

(1)   The determination in the principal instrument is varied:

(a) to number each of the paragraphs in the determination consecutively as
      clauses (1) to (8);

(b) in clause (2) to:

(i) omit “Nine national” and substitute “Eleven national”; and

(ii) omit “Attachments 1.02 – 1.10” and substitute
     “Attachments 1.02 – 1.09, 1.21 and 1.22”;

(c) in clause (4) to:

(i) omit “Six community” and substitute “Four community”; and
 (ii) omit “Attachment 1.16 to 1.26” and substitute “Attachments 1.18,
                  1.19, 1.23, 1.24, 1.25, 1.26 and 1.31”;

(d) in clause (5) to:

(i) omit “Four open narrowcasting” and substitute “Five open
     narrowcasting”; and
(ii) after “Attachments 1.27 – 1.30”, insert “and 1.32”;
 

(e) insert the following clauses after clause (8):

(9) “One community radio service is to be available in the area described at Attachment 5.01 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the service that is to be available in the area described at Attachment 5.01 is set out in Schedule Five and Attachments 5.02 and 5.03 to this Determination.”

(10) “A reference in this determination to a schedule or an attachment includes a reference to a schedule as amended from time to time.”

(2)   Under the heading “ScheduleS”, immediately following the determination:

(a) omit the words “Each of the Schedules set out:” and all eight paragraphs marked with dot points; and

(b) omit the three paragraphs following Schedule Four, including the headings and all text.

(3) The Schedules to the principal instrument are varied to:

(a) omit Schedule One of the principal instrument and substitute the table headed Schedule One in item 2 on page 5 of this instrument;

(b) in Schedule Two, Schedule Three, and Schedule Four omit column 2 including the heading “Status” and all text; and

(c) insert the table headed “Schedule Five” in item 3 on page 6 of this instrument after Schedule Four of the principal instrument.

(4) Attachments to the principal instrument are varied to:

(a) omit Attachment 1.01 of the principal instrument and substitute Attachment 1.01 of this instrument;

(b) omit Attachment 1.04 of the principal instrument and substitute Attachment 1.04 of this instrument;

(c) omit Attachments 1.17 and 1.20 of the principal instrument;

(d) omit Attachment 1.21 and 1.22 of the principal instrument and substitute Attachment 1.21 and 1.22 of this instrument;

(e) insert Attachments 1.31 and 1.32 of this instrument after Attachment 1.30 of the principal instrument;

(f)  omit Attachment 2.01 of the principal instrument and substitute Attachment 2.01 of this instrument;

(g) omit Attachment 2.02 of the principal instrument and substitute Attachment 2.02 of this instrument;

(h) omit Attachments 3.01 and 4.01 of the principal instrument and substitute Attachments 3.01 and 4.01 of this instrument; and

(i)  insert Attachments 5.01, 5.02 and 5.03 after Attachment 4.02 of the principal instrument.
