Exemption (subregulation 6(1)) (29/06/1990)

Reserve Bank of Australia in pursuance of Regulation 38 of the Banking (Foreign Exchange) Regulations hereby:

1. revokes the exemption dated 18 December 1984 relating to sub-regulation 6(1) of the Regulations and the taking out of Australia by any person of any Australian currency notes and coin not exceeding five thousand dollars;

2. revokes the exemption dated 18 December 1989 relating to sub-regulation 6(1) of the Regulations and the sending out of Australia by any person of Australian currency in the form of coin to a maximum value of five thousand dollars within any period of twelve months;

3. exempts from the application of sub-regulation 6(1) of the Regulations the taking or sending out of Australia by a person of any Australian currency.

This instrument shall come into operation on 1 July 1990.

The Banking (Foreign Exchange) Regulations 1959Exemption (subregulation 6(1)) (29/06/1990) was varied by the Banking (Foreign Exchange) Regulations 1959  Revocation of Variation of Exemption and Variation of Exemption (subregulation 6(1)) (17/10/2001). The Variation of Exemption was revoked by the Banking (Foreign Exchange) Regulations 1959 – Revocation of Variation of Exemption and Variation of Exemption (subregulation 6(1)) (04/10/2007).

 

The variations have not been incorporated in this compilation.

 

BANKING (FOREIGN EXCHANGE) REGULATIONS

REVOCATION OF VARIATION OF EXEMPTION AND
VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations hereby revokes the Variation of Exemption dated 22 December 1995 in the form published in the Commonwealth of Australia Gazette No. GN 1, 10 January 1996, relating to sub-regulation 6(1) of the Regulations.

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments by or on behalf of:

(i) the Embassy of the Federal Republic of Yugoslavia;  or

(ii) the ConsulateGeneral of the Federal Republic of Yugoslavia;  or

(iii) Narodna Banka Jugoslavije (including Banque Nationale de Yugoslavie)

and which exceeds a value of A$100,000.

All such transactions require the specific prior approval of the Reserve Bank of Australia.  Please refer applications for approval to the Manager, Market Analysis, International Department of the Reserve Bank in Sydney.

The revocation and variation contained in this instrument respectively come into operation on 17 October 2001.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations 1959 hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments directly or indirectly to, or for the benefit of any person listed in the Annex to this variation of exemption.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date of publication of the amendment in the Commonwealth of Australia Gazette.

This instrument comes into operation on 25 November 2002.

VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations 1959 hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments directly or indirectly to, or for the benefit of any person listed in the Annex to this variation of exemption.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 19 September 2006.

BANKING (FOREIGN EXCHANGE) REGULATIONS

REVOCATION OF VARIATION OF EXEMPTION AND
VARIATION OF EXEMPTION

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations hereby revokes the Variation of Exemption dated 17 October 2001 in the form published in the Commonwealth of Australia Gazette No. GN 42, 24 October 2001, relating to sub-regulation 6(1) of the Regulations.

The Reserve Bank of Australia pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments by or on behalf of:

(i) the Embassy of the Federal Republic of Yugoslavia; or [see Note 7]

(ii) the ConsulateGeneral of the Federal Republic of Yugoslavia; or [see Note 7]

(iii) Narodna Banka Jugoslavije (including Banque Nationale de Yugoslavie); or [see Note 7]

(iv) any person listed in the Annex to this variation of exemption.

For the persons referred to in paragraphs (i), (ii) and (iii) above, this variation of exemption applies to any transaction or payment which exceeds a value equivalent to A$100,000.

Pursuant to sub-regulation 6(1), all such transactions require the specific prior approval of the Reserve Bank of Australia.  Please refer applications for approval to the Senior Manager, Market Analysis, International Department of the Reserve Bank in Sydney.

The revocation and variation contained in this instrument respectively come into operation on 10 October 2007.

The Banking (Foreign Exchange) Regulations 1959 – Exemption (subregulation 6(1)) (29/06/1990) was varied by the Banking (Foreign Exchange) Regulations 1959 – Variation of Exemption relating to subregulation 6(1) – Burma (18/10/2007), as varied by the Banking (Foreign Exchange) Regulations 1959 Direction relating to foreign currency transactions and to Burma – Amendment to the Annex and Variation of Exemptions
Amendment to the Annexes (16/10/2008).

The variation, as amended, has not been incorporated in this compilation.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia, pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations 1959, hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments directly or indirectly to, or for the benefit of any person listed in the Annex to this variation of exemption.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 24 October 2007.

VARIATION OF DIRECTION RELATING TO FOREIGN CURRENCY TRANSACTIONS AND TO THE FEDERAL REPUBLIC OF YUGOSLAVIA

VARIATION OF VARIATIONS OF EXEMPTION

The Reserve Bank of Australia pursuant to Regulation 5 and sub-regulation 38(2) of the Banking (Foreign Exchange) Regulations hereby varies:

1. the Direction Relating to Foreign Currency Transactions and to the Federal Republic of Yugoslavia dated 5 April 2002 in the form published in the Commonwealth of Australia Gazette No. GN 20, 22 May 2002;

2. the Variation of Exemption dated 4 October 2007 in the form published in the Commonwealth of Australia Gazette No. GN 40, 10 October 2007, relating to sub-regulation 6(1) of the Regulations; and

3. the Variation of Exemption dated 17 October 2001 in the form published in the Commonwealth of Australia Gazette No. GN 42, 24 October 2001, relating to sub-regulation 8(1)(a) of the Regulations

so that the Direction and Variations of Exemption no longer apply to:

(i) the Embassy of the Federal Republic of Yugoslavia;  or

(ii) the ConsulateGeneral of the Federal Republic of Yugoslavia;  or

(iii) Narodna Banka Jugoslavije (including Banque Nationale de Yugoslavie).

The variations contained in this instrument come into operation on 9 July 2008.

BANKING (FOREIGN EXCHANGE) REGULATIONS 1959

VARIATION OF EXEMPTION

The Reserve Bank of Australia, pursuant to subregulation 38(2) of the Banking (Foreign Exchange) Regulations 1959, hereby varies the Exemption dated 29 June 1990 relating to subregulation 6(1) of the Regulations so that the Exemption does not apply to the taking or sending out of Australia by a person of any Australian currency derived or generated from property, securities or funds owned or controlled directly or indirectly by, or otherwise relating to payments directly or indirectly to, or for the benefit of any person or entity listed in the Annex to this variation of exemption.

The Annex to this variation of exemption may be amended from time to time.  Any such amendment shall be taken as being part of this variation of exemption as from the date specified in the amendment.

This instrument comes into operation on 15 October 2008.
