1 Name of Determination
This instrument is the Financial Management and Accountability Net Appropriation Agreement Variation 2005.
2 Commencement
This instrument will commence on 30 June 2005.
3 Variation of Net Appropriation Agreements
Schedule 1 varies all Net Appropriation Agreements made pursuant to section 31 of the Financial Management and Accountability Act 1997, except for the agreement in respect of the Australian National Audit Office.

5A Additional Eligible Receipts
5A.1 Receipts of the agency up to 30 June 2005 that would have been eligible receipts for the purposes of an ineffective net appropriation agreement, if that agreement had been effective, are eligible receipts for the purposes of this agreement.
5A.2 Receipts covered by this clause are eligible receipts for the purposes of this agreement notwithstanding clause 2.1.2.
5A.3 In this clause:
‘ineffective net appropriation agreement’ means a document signed by the Minister responsible for the Agency or an official of the Agency and an official of the Department of Finance and Administration that purported to be a net appropriation agreement in relation to the Agency which was not an effective net appropriation agreement.
