Exemption number CASA EX15/2005

Exemption  carriage of life rafts

1 Revocation

 CASA EX39/2004 is revoked.

2 Duration

 This instrument:

(a) commences on the day after it is registered on the Federal Register of Legislative Instruments; and

(b) stops having effect at the end of May 2008.

3 Application

 This instrument applies to Embraer EMB 120 Brasilia aircraft operated by Regional Pacific Airlines Pty Ltd (Aviation Reference Number 568330) in any of the following operations:

(a) between Cairns and Port Moresby or Nadzab (Lae) in Papua New Guinea;

(b) between Townsville and Port Moresby or Nadzab (Lae) in Papua New Guinea;

(c) between Cairns and Gove, Groote Eylant or Darwin;

(d) between Weipa and Gove, Groote Eylant or Darwin;

(e) between Bamaga and Gove, Groote Eylant or Darwin;

(f) between Horn Island and Gove, Groote Eylant or Darwin.

4 Exemption

 (1)The aircraft are exempt from compliance with the directions under subregulation 252 (1) of CAR 1988 to the extent mentioned in subsection (2).

 (2)The exemption applies only to the requirement to comply with paragraph 5.2.1 of section 20.11 of the Civil Aviation Orders (the CAOs) in relation to the carriage of life rafts.

5 Condition

 The exemption is subject to the condition that the aircraft must be within the lesser of:

(a) 60 minutes at single engine cruising speed; or

(b) 200 nautical miles;

 from an adequate aerodrome as defined in CAO 82.0.
