1 Citation [see Note 1]

  This Determination may be cited as the Radiocommunications (Transmitter and Receiver Licences) Determination.

2 Commencement

  This Determination commences on 3 April 1995.

3 Interpretation

  In this Determination, unless the contrary intention appears:

Act means the Radiocommunications Act 1992.

4 Transmitter licences

  For the purposes of subsection 98 (1) of the Act, the ACMA may issue a transmitter licence of a type specified in column 2 of an item in Schedule 1.

Note   For the descriptions of the licences specified in Schedule 1, see the Radiocommunications (Interpretation) Determination 2000.

5 Receiver licences

  For the purposes of subsection 98 (1) of the Act, the ACMA may issue a receiver licence of a type specified in column 2 of an item in Schedule 2.

Note   For the descriptions of the licences specified in Schedule 2, see the Radiocommunications (Interpretation) Determination 2000.

6 Revocation of the Radiocommunications (Transmitters) Determination and the Radiocommunication (Receivers) Determination

  The following determinations are revoked:

 (a) Radiocommunications (Receivers) Determination No. 1 of 1993;

 (b) Radiocommunications (Transmitters) Determination No. 1 of 1993;

 (c) Radiocommunications (Transmitters) Determination (Amendment);

 (d) Radiocommunications (Transmitters) Determination No. 1 of 1993 (Amendment No. 2).

7 Transitional arrangements

 (1) Despite the revocation of a determination by clause 6:

 (a) a licence issued before the commencement of this Determination, and in force on the day on which this Determination commences, remains in force until the end of the period specified in the licence in accordance with subsection 103 (2) of the Act, and may be suspended or cancelled; and

 (b) a licence issued before the commencement of this Determination, but that is under suspension on the day on which this Determination commences:

 (i) remains suspended until the suspension ceases in accordance with section 127 of the Act; and

 (ii) after the suspension has ceased  has force until the end of the period specified in the licence in accordance with subsection 103 (2) of the Act, and may be suspended or cancelled;

as if the first-mentioned determination had not been revoked.

 (2) An application under section 129 of the Act for the renewal of a transmitter licence, or a receiver licence:

 (a) issued in respect of a radiocommunications transmitter or receiver before the date of commencement of this Determination; and

 (b) being an application that has not been determined by the SMA before that date;

takes effect as an application for a renewal of a licence of the type set out in subclause (3).

 (3) The type of licence referred to in subclause (2) is a licence of a type that:

 (a) is specified in a Schedule to this Determination; and

 (b) is suitable for the purpose for which the transmitter or receiver is operated.
