Defence Force Discipline (Consequences of Punishment) Rules2 (Amendment)

I, Peter Courtney Gration, Chief of the Defence Force, make the following Rules under subsection 68 (2) of the Defence Force Discipline Act 1982.

1.   Amendment

1.1   The Defence Force Discipline (Consequences of Punishment) Rules are amended as set out in these Rules.

[NOTE:  These Rules commence on gazettal: see Acts Interpretation Act 1901, s. 48 and Defence Force Discipline Act 1982, s. 68b.]

2.   Rule 3  (Interpretation)

2.1   Subrule 3 (1):

Insert the following definition:

‘non-working day’ means a day designated as a rest day or non-working day by the standing, routine or daily orders of the unit, establishment or ship in which the member is serving punishment;”.

3.   Rule 6  (Consequences of punishment of restriction of privileges)

3.1   Subparagraphs 6 (c) (i) and (ii):

Omit the subparagraphs, substitute:

 “(i) additional duties:

 (A) for a period not exceeding 4 hours outside working hours in a working day; and

 (B) for a period not exceeding 8 hours in a non-working day; or

 (ii) if the member cannot be employed effectively in additional duties for all or part of a period referred to in subparagraph (i)—drill for a period not exceeding 1 hour in each day;”.

4.   Rule 7  (Consequences of punishment of stoppage of leave)

4.1   Add at the end:

 “;  (d) the member shall not consume any alcoholic beverage.”.

5.   Rule 8  (Consequences of punishment of extra duties)

5.1   Subparagraphs 8 (a) (i) and (ii):

Omit the subparagraphs, substitute:

 “(i) additional duties outside working hours for a period not exceeding 4 hours in each day; or

 (ii) if the member cannot be employed effectively in additional duties for all or part of the period referred to in subparagraph (i)—drill for a period not exceeding 1 hour in each day;”.
