1 Name of regulations

  These regulations are the Customs (Prohibited Imports) Amendment Regulations 1999 (No. 1).

2 Commencement

  These regulations commence on gazettal.

  Schedule 1 amends the Customs (Prohibited Imports) Regulations.

  These regulations are the Customs (Prohibited Imports) Regulations 1956.

4M Importation of unset diamonds from Angola

 (1) In this regulation:

authorised person means an officer of the Department of Foreign Affairs and Trade authorised in writing by the Foreign Minister for the purposes of this regulation.

Foreign Minister means the Minister for Foreign Affairs.

unset diamonds means diamonds classified under heading 7102 of Schedule 3 to the Customs Tariff Act 1995.

Note   Heading 7102 of that Schedule (omitting the tariff rates) is as follows:

7102 DIAMONDS, WHETHER OR NOT WORKED, BUT NOT MOUNTED OR SET:

7102.10.00 Unsorted

7102.2 Industrial:

7102.21.00 Unworked or simply sawn, cleaved or bruted

7102.29.00 Other

7102.3 Non-industrial:

7102.31.00 Unworked or simply sawn, cleaved or bruted

7102.39.00 Other.

 (2) The importation of unset diamonds from Angola, or of Angolan origin, is prohibited unless the written permission of the Foreign Minister or an authorised person is produced to a Collector at or before the time of importation.

 (3) When deciding whether to give permission under subregulation (2), the Foreign Minister or an authorised person must take into account:

 (a) whether the diamonds are controlled through the Certificate of Origin system operated by the Government of Unity and National Reconciliation of Angola; and

 (b) Australia’s relations with other countries; and

 (c) Australia’s obligations under international law.

 (4) A permission granted under subregulation (2) may specify, in relation to the importation of diamonds that it permits:

 (a) conditions or requirements, including times for compliance, to which the importation is subject; and

 (b) the quantity of diamonds that may be imported; and

 (c) the circumstances in which the diamonds may be imported.

 (5) The Foreign Minister may revoke or modify a permission granted under subregulation (2) if there are reasonable grounds for believing that:

 (a) a condition or requirement of the permission has not been complied with or, unless modified, is unlikely to be complied with; or

 (b) permitting, or continuing to permit, the importation of goods in accordance with the permission would infringe the international obligations of Australia.
