Superannuation (Resolution of Complaints) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Superannuation (Resolution of Complaints) Act 1993.

1.   Commencement

1.1   These Regulations commence on the date of commencement of the Retirement Savings Accounts Act 1997.

2.   Amendment

2.1   The Superannuation (Resolution of Complaints) Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Interpretation)

3.1   Definition of “disability benefit”:

Omit the definition.

4.   Regulation 4 (Excluded complaints)

4.1   Omit the regulation.

5.   Regulation 5 (Payment of death benefits—period for objections and complaints)

5.1   Omit “and subparagraph 15C (2) (a) (ii)”, substitute “, subparagraph 15C (2) (a) (ii), paragraph 15F (2) (b), subparagraph 15G (2) (a) (ii), paragraph 15J (2) (b) and subparagraph 15K (2) (a) (ii)”.

6.   Regulation 7 (Method of calculation of interest)

6.1   Omit “and subparagraph 37B (2) (a) (iii)”, substitute “and subparagraphs 37B (2) (a) (iii), 37D (3) (a) (iv), 37D (5) (a) (iv), 37F (3) (a) (iv) and 37F (5) (a) (iv)”.

6.2   After paragraph (c), add:

 “or (d) money received under an RSA; or

 (e) money received under a contract of insurance, the premiums for which are paid from an RSA;”.

7.   Schedule 2 (Complaint—Handling Bodies)

7.1   Add at the end:

Insurance Enquiries and Complaints Limited”.
