National Health Regulations 2 (Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the National Health Act 1953.

1. Commencement
1.1 These Regulations commence on 1 September 1991.
2. Amendment
2.1 The National Health Regulations are amended as set out in these Regulations.
3. New regulation 3E
3.1 After regulation 3D, insert:
Nursing care at home in lieu of hospital treatment—modifications of section 4 of the Act
“3E.During the period of 18 months beginning on 1 September 1991, section 4 of the Act, in its application to the the registered health benefits organisations specified in Schedule 3, has effect subject to the modifications set out in Schedule 4.”.

4.1 After Schedule 2, add:

SCHEDULE 4 Regulation 3E
MODIFICATIONS OF SECTION 4 OF THE ACT
1. Subsection 4 (1) (definition of “ ‘basic private table’ or ‘basic table’ ”):
Before paragraph (a), insert:
“(aa) for nursing care provided to an outreach patient by Hospital Extension Services Pty. Ltd.—benefits equal to the lesser of:
(i) the fees or charges incurred for the nursing care for each day on which it is provided; or
(ii) $95.45 for each day on which the nursing care is provided.”.

2. Subsection 4 (1):
After the definition of “organization”, insert:
“ ‘outreach patient’ means an individual:
(a) to whom hospital treatment has been provided in the Royal North Shore Hospital Sydney; and
(b) to whom nursing care is provided outside the Royal North Shore Hospital Sydney by Hospital Extension Services Pty. Ltd. in lieu of hospital treatment.”.
