WHEREAS it is provided by sub-section 101 (4) of the National Health Act 1953 that a drug or medicinal preparation that was not a pharmaceutical benefit under that Act immediately before the commencement of that sub-section shall not be prescribed as a pharmaceutical benefit in accordance with section 85 of that Act unless the Pharmaceutical Benefits Advisory Committee has recommended to the Minister that it be so prescribed:
AND WHEREAS the Pharmaceutical Benefits Advisory Committee has recommended to the Minister that the following drugs and medicinal preparations be prescribed as pharmaceutical benefits under section 85 of the National Health Act 1953, namely the drugs and medicinal preparations specified in Schedule 3 to the National Health (Pharmaceutical Benefits) Regulations, as amended by the following Regulations, that had not previously been prescribed as pharmaceutical benefits:
AND WHEREAS it is desirable, amongst other things, to prescribe, for the purposes of section 85 of the National Health Act 1953, each drug and medicinal preparation so recommended by the Pharmaceutical Benefits Advisory Committee:
NOW THEREFORE I, the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the National Health Act 1953.

Commencement
1. These Regulations shall come into operation on 1 December 1980.
Prescribed pharmaceutical benefits, &c., for purposes of section 88A of the Act
2. Regulation 14 of the National Health (Pharmaceutical Benefits) Regulations is amended—
(a) by omitting sub-regulations (1) and (2) and substituting the following sub‑regulations:
“(1) Each pharmaceutical benefit the name of which is specified in column 2 of an item in Schedule 5 is prescribed for the purposes of section 88A of the Act.
“(2) The following circumstances are prescribed in relation to each pharmaceutical benefit the name of which is specified in column 2 of an item in Schedule 5:
(a) where a class of persons is specified in column 3 of that item—that the pharmaceutical benefit is to be supplied for the treatment of a person included in that class of persons;
(b) where a disease or condition is specified in column 3 of that item—
(i) if sub-paragraph (ii) does not apply—that the pharmaceutical benefit is to be supplied for the treatment of that disease or condition in relation to any person; or
(ii) if the disease or condition is specified in relation to a specified class of persons—that the pharmaceutical benefit is to be supplied for the treatment of that disease or condition in a person included in that class of persons;
(c) where a purpose is specified in column 3 of that item—that the pharmaceutical benefit is to be supplied for that purpose;
(d) where it is specified in column 3 of that item that the written authority of the Permanent Head is required-that an application for the written authority of the Permanent Head in relation to the writing of a prescription for the supply of the pharmaceutical benefit has been made by the medical practitioner intending to write the prescription and the Permanent Head has, in accordance with sub-regulation (3), approved the application.”;
(b) by omitting from sub-regulation (3) “under sub-regulation (2)” and substituting “referred to in paragraph (2) (d)”;
(c) by omitting from sub-regulation (3) “or participating dental practitioner”; and
(d) by omitting sub-regulation (4).

3. Schedules 1, 2, 3, 4 and 5 of the National Health (Pharmaceutical Benefits) Regulations are repealed and the following Schedules substituted:
