Health Insurance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and pursuant to section 4 of the Acts Interpretation Act 1901, hereby make the following Regulations under the Health Insurance Act 1973.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Health Insurance Regulations.

2. The Principal Regulations are amended by inserting after regulation 2ab the following regulations:

Declaration of organisations and qualifications—

sub-section 3d (1) of the Act

2aba. (1) For the purposes of sub-section 3d (1) of the Act, the organisation specified in Column 2 of an item in Schedule 6 is declared to be a professional organisation in relation to a particular specialty specified in Column 3 of that item.

“(2) For the purposes of sub-section 3d (1) of the Act, the qualification specified in Column 4 of an item in Schedule 6 is declared to be a relevant qualification in relation to the organisation specified in Column 2 of that item.

Prescribed fee—sub-section 3d (1) of the Act

“2abb. For the purposes of sub-section 3d (1) of the Act, the prescribed fee is $30.

Prescribed fee—sub-section 3e (2) of the Act

“2abc. For the purposes of sub-section 3e (2) of the Act, the prescribed fee is $30.”.

3. The Principal Regulations are amended by inserting after regulation 9 the following regulation:

Prescribed fee—sub-section 61 (lA) of the Act

“9aa. For the purposes of sub-section 61 (1a) of the Act, the prescribed fee is $30.”.

4. The Principal Regulations are amended by inserting after regulation 9a the following regulations:

Professional organisation—sub-section 124b (1) of the Act

“9ab. For the purposes of the definition of ‘professional organisation’ in sub-section 124b(1) of the Act, each of the following organisations or associations is declared to be a professional organisation:

(a) Australian Dental Association Incorporated;

(b) Australian Medical Association;

(c) Australian Optometrical Association.

Prescribed rate of interest—sub-section 129ac (2) of the Act

“9ac. For the purposes of sub-section 129ac (2) of the Act, the prescribed rate is 15 per cent per annum.”

5. The Principal Regulations are amended by adding at the end the following Schedule:
