Occupational Health and Safety (Commonwealth Employment) Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Occupational Health and Safety (Commonwealth Employment) Act 1991.

1.   Amendment

1.1   The Occupational Health and Safety (Commonwealth Employment) Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   New  regulation 36AA:

2.1   Before regulation 36, insert in Part 5:

Application of Part 5 of the Act to employees working at a place that is not Commonwealth premises

 “36AA. For the purposes of section 15 of the Act, Part 5 of the Act (other than section 82) applies to an employee who ordinarily performs his or her work at a particular place that is not Commonwealth premises.”.
