Export Inspection (Establishment
Registration Charges) Regulations2
(Amendment)
I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, hereby make the following Regulations under the Export Inspection (Establishment Registration Charges) Act 1985.

Commencement
1. These Regulations commence on the date of commencement of the Export Inspection (Establishment Registration Charges) Amendment Act 1987.
Principal Regulations
2. In these Regulations, “Principal Regulations” means the Export Inspection (Establishment Registration Charge) Regulations.
Citation
3. Regulation 2 of the Principal Regulations is amended by omitting “Charge” and substituting “Charges”.
4. Regulation 3 of the Principal Regulations is repealed and the following regulation substituted:

Interpretation
“3. In these Regulations:
‘prescribed day’, in relation to the registration of an establishment means:
(a) where the establishment is or was first registered on the twenty-eighth, twenty-ninth, thirtieth or thirty-first day in a month—the twenty-eighth day in any month; or
(b) where the establishment is or was first registered on any other day in a month—that day in any month;
‘prescribed month’, in relation to the registration of an establishment, means the period:
(a) commencing at the beginning of the prescribed day in a month; and
(b) ending immediately before the beginning of the prescribed day in the next month;
or any part of that period; ‘the Act’ means the Export Inspection (Establishment Registration Charges) Act 1985.”.
Imposition of charge
5. Regulation 4 of the Principal Regulations is amended by adding at the end the following subregulation:
“(2) For the purposes of section 6 of the Act, in relation to the registration of an establishment for any operations associated with the preparation of a prescribed commodity referred to in subregulation (1), the charges are to be imposed in respect of the following periods:
(a) for the year commencing on the day on which the establishment is first registered; and
(b) for each succeeding year during which the establishment is registered; and
(c) on the registration of the establishment for operations in addition to that or those for which the establishment is registered—for the period:
(i) commencing at the beginning of the prescribed month in which the establishment is registered for the additional operations; and
(ii) ending on the anniversary of the first registration of the establishment that first occurs after that prescribed month.
6. Regulation 6 of the Principal Regulations is repealed and the following regulation substituted:
Rates of charge
“6. For the purposes of section 7 of the Act:
(a) in relation to the registration of an establishment specified in Column 2 of one item in the Schedule, the rate of charge is the rate, per prescribed month, specified in Column 3 of the item; and
(b) in relation to the registration of an establishment specified in Column 2 in more than one item in the Schedule, the rate of charge is the higher or highest of the rates, per prescribed month, specified in Column 3 of any of those items.”.

7. The Schedule to the Principal Regulations is repealed and the following Schedule substituted:
