Export Inspection (Service Charge)

Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and pursuant to section 4 of the Acts Interpretation Act 1901, hereby make the following Regulations under the Export Inspection (Service Charge) Act 1985.

Commencement

1. These Regulations shall come into operation on 1 January 1986.

Citation

2. These Regulations may be cited as the Export Inspection (Service Charge) Regulations.

Interpretation

3. In these Regulations, unless the contrary intention appears, the Act means the Export Inspection (Service Charge) Act 1985.

Imposition of charge

4. The following prescribed commodities are specified for the purposes of sub-section 6 (1) of the Act:

(a) eggs;

(b) fish;

(c) edible game offal;

(d) game meat;

(e) game meat products.

Rates of charge

5. (1) For the purposes of section 7 of the Act, the rate of charge applicable to an establishment that is registered for operations associated with the preparation of—

(a) eggs is $30 per hour or part thereof for each attendance by an authorised officer;

(b) fish is—

(i) $50 for each attendance by an authorised officer for a continuous period of one hour; and

(ii) $50 per hour or part thereof for each attendance by an authorised officer occurring in a prescribed monthly aggregate; and

(c) edible game offal, game meat or game meat products is—

(i) $12 per hour or part thereof for each attendance by an authorised officer who is a meat inspector; and

(ii) $15 per hour or part thereof for each attendance by an authorised officer who is a veterinary officer,

with a minimum charge of $45 for each attendance.

(2) In sub-regulation (1)—

prescribed monthly aggregate means the aggregate of the prescribed periods in any month;

prescribed period means—

(a) in the case of an attendance at an establishment by an authorised officer for the purpose of providing an export inspection service for a period that is less than one hour— that period; or

(b) in any other case—the period for which the authorised officer was so engaged, less the number of whole hours in that period.
