1 Commencement

  These regulations shall come into operation on 1 January 1986.

2 Citation [see Note 1]

  These regulations may be cited as the Export Inspection (Service Charge) Regulations.

3 Interpretation

  In these regulations, unless the contrary intention appears:

Act  means the Export Inspection (Service Charge) Act 1985.

Export Control Orders means the Export Control (Processed Fruits and Vegetables) Orders.

processed fruits and vegetables means fruits and vegetables declared to be prescribed goods in the Export Control Orders as in force on 1 July 1991.

4 Imposition of charge

  The following prescribed commodities are specified for the purposes of subsections 6 (1) and 6 (3) of the Act:

 (a) dairy products;

 (b) dried fruits;

 (c) fish;

 (d) eggs;

 (e) processed fruit;

 (f) processed vegetables.

5 Rates of charge

 (1) For the purposes of subsection 7 (1) of the Act, the rate of charge for the provision of an export inspection service at an establishment is:

 (a) for an establishment relating to dairy products or eggs — $60 for the first half hour or a part of that half hour, and $30 for each subsequent quarter hour or a part of a quarter hour; and

 (b) for an establishment relating to fish — $66 for the first half hour or a part of that half hour, and $33 for each subsequent quarter hour or a part of a quarter hour; and

 (c) for an establishment relating to dried fruits — $105 for the first half hour or a part of that half hour, and $52.50 for each subsequent quarter hour or a part of a quarter hour; and

 (d) for an establishment relating to processed fruits and vegetables — $70 for the first half hour or a part of that half hour, and $35 for each subsequent quarter hour or a part of a quarter hour.

 (2) For the purposes of subsection 7 (2) of the Act, the rate of charge for the provision of an external export inspection service is:

 (a) for a service relating to dairy products or eggs — $60 for the first half hour or a part of that half hour, and $30 for each subsequent quarter hour or a part of a quarter hour; and

 (b) for a service relating to fish — $66 for the first half hour or a part of that half hour, and $33 for each subsequent quarter hour or a part of a quarter hour; and

 (c) for a service relating to dried fruits — $105 for the first half hour or a part of that half hour, and $52.50 for each subsequent quarter hour or a part of a quarter hour; and

 (d) for a service relating to processed fruits and vegetables — $70 for the first half hour or a part of that half hour, and $35 for each subsequent quarter hour or a part of a quarter hour.

 (3) In this regulation:

external export inspection service means an export inspection service provided by an authorised officer that:

 (a) is carried out at an office of the Department or an office of a Department of the Government of a State or Territory; and

 (b) does not relate to the preparation of documents for the export of a commodity or provision of exemption from Export Control Orders.

6 Exemption from Export Control Orders

 (1) For the purposes of section 7 of the Act, the rate of charge for an export inspection service determining whether an establishment may be exempted from Export Control Orders is:

 (a) for the first service by an authorised officer in a year — $75 for each half hour or part of a half hour with a minimum charge of $150.00; and

 (b) for a second service by an authorised officer in a year — $83.30 per half hour or part of a half hour with a minimum charge of $250.00; and

 (c) for a third or subsequent service by an authorised officer in a year — $83.30 per half hour or part of a half hour with a minimum charge of $500.00.

 (2) In subregulation (1), year means the period of 12 months commencing at the beginning of the day of the making of the first application.
