REGULATIONS UNDER THE COMMERCE (TRADE

DESCRIPTIONS) ACT 1905–1950.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Commerce (Trade Descriptions) Act 1905–1950.

Amendments of the Commerce (Imports) Regulations.†

Commencement.

1. These Regulations shall come into operation upon the expiration of six months after the date on which they are notified in the Gazette.

Definitions.

2. Regulation 5 of the Commerce (Imports) Regulations is amended by omitting the definition of “leather”.

Conditional prohibition of certain imports.

3. Regulation 7 of the Commerce (Imports) Regulations is amended—

(a) by omitting paragraph (g) and inserting in its stead the following paragraph:—

“(g) leather intended for, or usually employed in, the manufacture of boots, shoes and other apparel;”;

(b) by inserting after paragraph (h) the following paragraph:—

“(ha) goods, the total outside area of which is not less than twenty-four square inches, specified in the Fourth Schedule to these Regulations, being—

(i) goods made from leather or a material resembling leather;

(ii) goods made from fibre or vulcanite or a material resembling fibre or vulcanite; or

(iii) goods made from plastic;”; and

(c) by adding at the end thereof the following sub-regulation:—

“(2.) For the purposes of paragraph (ha) of the last preceding sub-regulation, goods shall be deemed to be made from—

(a) leather or a material resembling leather;

(b) fibre or vulcanite or a material resembling fibre or vulcanite; or

(c) plastic,

if more than one-half of the outside area of the goods consists of leather, a material resembling leather, fibre, a material resembling fibre, vulcanite, a material resembling vulcanite or plastic, as the case requires.”.

Articles of apparel, textile products and leather.

4. Regulation 15 of the Commerce (Imports) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(16.) In this regulation, ‘leather’ means leather intended for, or usually employed in, the manufacture of boots, shoes and other apparel.”.

Goods specified in the Fourth Schedule.

5. After regulation 15 of the Commerce (Imports) Regulations the following regulation is inserted:—

15a. In the case of goods specified in the Fourth Schedule to these Regulations, the trade description should state the name of the material or materials constituting the outside or covering of the goods.”.

Third Schedule.

6. The Third Schedule to the Commerce (Imports) Regulations is amended—

(a) by inserting, after the words “Coir mats and matting;”, the words “seagrass mats and matting;”; and

(b) by inserting after the words “Sporting Goods” the words “(not being goods specified in the Fourth Schedule to these Regulations made, or deemed to have been made, from a material referred to in sub-paragraph (i), (ii), or (iii) of paragraph (ha) of sub-regulation (1.) of regulation 7 of these Regulations)”.

Fourth Schedule.

7. The Commerce (Imports) Regulations are amended by adding at the end thereof the following Schedule:—
