REGULATIONS UNDER THE DEFENCE ACT 1903-1956.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Defence Act 1903-1956.

Defence (Prohibited Words and Letters) Regulations.

Citation.

1. These Regulations may be cited as the Defence (Prohibited Words and Letters) Regulations.

Use of words and groups of letters prohibited without consent

2. The use, in connexion with a trade, business, calling or profession or by an organization or body of persons, of—

(a) a word or the words specified in the second column of the Schedule to these Regulations, being words which are descriptive or indicative of—

(i) in the case of a word or the words specified in Part I. of the Schedule to these Regulations—a part of the Naval Forces of the Commonwealth;

(ii) in the case of words specified in Part II. of the Schedule to these Regulations—a part of the Military Forces of the Commonwealth;

(iii) in the case of a word or the words specified in Part III. of the Schedule to these Regulations—of a part of the Royal Australian Air Force;

(iv) in the case of the words specified in Part IV. of the Schedule to these Regulations—of a part of the Naval Forces of the United Kingdom; or

(v) in the case of the words specified in Part V. of the Schedule to these Regulations—of a part of the Air Forces of the United Kingdom; or

(b) a group of letters specified in the second column of any of the Parts of the Schedule to these Regulations, being a group of letters which is descriptive or indicative of the part of the Naval Forces, Military Forces or Air Forces opposite to which the group is specified,

is prohibited unless the consent in writing of the Minister to the use has been obtained.

Applications for consent.

3.—(1.) An application for the consent of the Minister to the use of a word or words, or a group of letters specified in the first or second column of the Schedule to these Regulations shall be made in writing to the Minister and shall state the grounds upon which the application is made.

(2.) The Minister may, by notice in writing, require a person who has made such an application to furnish such additional information in relation to the application as is required by the notice.

Grants or refusal of consent.

4. The Minister may, in his discretion, grant his consent to the use of the word, words or group of letters or may refuse the application.

Offences.

5. A person shall not use a word, words or a group of letters in contravention of regulation 2 of these Regulations.

Penalty: Twenty pounds or imprisonment for three months.
