Family Law (Child Abduction Convention) Regulations 2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Family Law Act 1975.

1.   Amendment

1.1   The Family Law (Child Abduction Convention) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48]

2.   Regulation 2 (Interpretation)

2.1   After subregulation 2 (1), insert:

 “(1a) A reference in these regulations to a form by number is a reference to the form so numbered in Schedule 3.”.

3.   Regulation 11 (Application for return of child abducted from Australia)

3.1   Subregulation 11 (2):

Omit “in Schedule 3”.

4.   Regulation 15 (Orders)

4.1   Subregulation 15 (2):

Omit the subregulation, substitute:

 “(1a)An application under subregulation (1) must be in accordance with Form 2.

 “(1b)If an application is made under subregulation (1), the respondent may file an answer, or an answer and cross application, in accordance with Form 2a.

 “(2) A court may, in respect of:

 (a) an application made under subregulation (1); or

 (b)an answer, or an answer and cross application, made under subregulation (1b);

make an order mentioned in subregulation (1) or any other order that the court thinks fit.”.

4.2   Subregulation 15 (4):

Omit the subregulation, substitute:

 “(4) If an answer, or an answer and cross application, is made under subregulation (1b), the applicant may file a reply in accordance with Form 2b.”.

5.   Regulation 24 (Access—general)

5.1   Subregulation 24 (3):

Omit “in Schedule 3”.

5.2   Subregulation 24 (6):

Omit the subregulation, substitute:

 “(5a)An application under subregulation (5) must be in accordance with Form 4.

 “(5b)If an application is made under subregulation (5), the respondent may file an answer, or an answer and cross application, in accordance with Form 4a.

 “(6) A court may, in respect of:

 (a) an application made under subregulation (5); or

 (b) an answer, or an answer and cross application, made under subregulation (5b);

make any order in relation to rights of access to a child that the court thinks fit.”.

5.3   Subregulation 24 (7):

Omit the subregulation, substitute:

 “(7) If an answer, or an answer and cross application, is made under subregulation (5b), the applicant may file a reply in accordance with Form 4b.”.

6   Schedule 2 (Convention countries)

6.1   Add at the end:

7.1   After Form 2, insert:
