Civil Aviation (Fees) Regulations

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and under section 4 of the Acts Interpretation Act 1901, make the following Regulations under the Civil Aviation Act 1988.

Citation

 1. These Regulations may be cited as the Civil Aviation (Fees) Regulations.

Commencement

 2. These Regulations commence when section 3 of the Civil Aviation Legislation Amendment Act 1995 commences.

Fees for safety audit programs

 3. (1)  The fee payable by an operator named in the table below for the carrying out of a safety audit program in the financial year beginning on 1 July 1995 is the amount set out in the table beside the operator’s name.

 (2) The fee is payable in four equal instalments, due on 1 August 1995, 1 November 1995, 1 February 1996 and 1 May 1996, respectively.

Regulatory service fees

 4. (1)  The fee for a service referred to in the second column of the Schedule is:

 (a) if an amount is set out in the third column of the Schedule beside the reference to the service—that amount;  or

 (b) if “HR” is set out in the third column of the Schedule beside the reference to the service—the amount worked out by multiplying the hourly rate by the number of hours spent by the service provider in providing the service.

 (2) For the purposes of subregulation (1), the hourly rate is:

 (a) for providing consultancy advice—the amount equal to the cost of providing the service for an hour; or

 (b) for any other service—$75.00 per hour.
