(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Aboriginal and Torres Strait Islander Heritage Protection Act 1984.

Principal Regulations

1. In these Regulations, Principal Regulations means the Aboriginal and Torres Strait Islander Heritage Protection Regulations.

2. After regulation 3 of the Principal Regulations the following regulation is inserted:

Community areas—Victoria

“3a. For the purposes of the definition of community area in subsection 21a (1) of the Act, each area specified in Schedule 4, being the area in Victoria of a local Aboriginal community within the meaning of Part IIa of the Act, is declared to be the area of that community for the purposes of that Part..

3. After regulation 5 of the Principal Regulations the following regulation is inserted:

Further amendment of Schedule to the Act

“5a. For the purposes of subsection 21a (2) of the Act, the Schedule to the Act is further amended:

(a) by omitting Bendigo Dja Dja Wung and substituting Bendigo Dja Dja Wrung;

(b) by inserting and after Sunraysia;

(c) by omitting Lake Tyres and substituting Lake Tyers;

(d) by inserting West Gippsland Aboriginal Co-operative Ltd. after Wathaurong Aboriginal Co-operative Ltd..

4. After regulation 6 of the Principal Regulations the following regulations are inserted:

Notification of emergency declaration of preservation

6a. (1) A notification under subsection 21c (4) or (5) of the Act must include:

(a) the name and address of each person to whom the notification is to be given; and

(b) a statement that the emergency declaration has been made, varied or revoked, as the case requires; and

(c) if the notification relates to the making or variation of an emergency declaration:

(i) the contents of the declaration or variation; and

(ii) a description of the land to which the declaration or the variation relates.

(2) A notification under subsection 21c (4) or (5) of the Act must be signed by the person giving the notification..

Notice of advice or determination

6b. (1) A notice under paragraph 21d (2) (a) or 21e (2) (a) of the Act must include:

(a) the name and address of each person to whom the notice is to be given; and

(b) the contents of the advice or determination; and

(c) a description of any land to which the advice or determination relates.

(2) A notice under paragraph 21d (2) (a) or 21e (2) (a) of the Act must be signed by the person giving the notice..


Temporary declarations and declarations of preservation

6c. A temporary declaration under paragraph 21d (3) (a) of the Act and a declaration of preservation under paragraph 21e (3) (a) of the Act must include:

(a) the date on which any advice under subsection 21d (1) of the Act in respect of the subject matter of the declaration was received by the Minister; and

(b) the name of the local Aboriginal community giving the advice; and

(c) the name of any person nominated by the local Aboriginal community as the communitys contact person in respect of the subject matter of the declaration; and

(d) a description of the place or object in respect of which the determination has been made, including any name or names of the place or object; and

(e) a concise description of the significance to the local Aboriginal community of the place or object; and

(f) a detailed description of the land where the place is situated or a description of the place where the object is located; and

(g) the name and address of the owner or occupier of the land or place; and

(h) a concise statement of the grounds on which the declaration has been made.

Notice of temporary declaration

6d. (1) A notice under subsection 21d (5) of the Act must include:

(a) the name and address of each person to whom the notice is to be given; and

(b) a statement that the temporary declaration has been made, varied or revoked, as the case requires; and

(c) if the notice relates to the making or variation of a temporary declaration:

(i) a statement of the contents of the declaration or variation: and

(ii) a description of the land to which the declaration or variation relates.

(2) A notice under subsection 21d (5) of the Act must be signed by the person giving the notice..

5. After regulation 9 of the Principal Regulations, the following regulation is inserted:

Consent under subsection 21u (4) of the Act

9a. A consent under subsection 21u (4) of the Act must:

(a) state the name and address of the person to whom the consent is given; and


(b) describe the area of any land to which the consent relates..

6. The Principal Regulations are amended by adding at the end the following Schedule:

SCHEDULE 4 Regulation 3a

COMMUNITY AREAS IN RELATION TO LOCAL ABORIGINAL COMMUNITIES IN VICTORIA

Note: the community area boundaries described in this Schedule are depicted graphically on four maps at the scale of 1:500,000 covering the total area of the State of Victoria. These maps are held in the Office of the Minister Responsible for Aboriginal Affairs (Victoria) in Melbourne and may be viewed at that Office upon written request to the Minister. In the following descriptions, kms means kilometres.

Area 1: BALLARAT AND DISTRICT ABORIGINAL CO-OPERATIVE LTD.

The boundary commences in Daylesford at the junction of the Midland Highway and the Ballan-Daylesford Road, thence west-south-west along the Midland Highway to Eganstown, thence in a north-westerly direction following the Creswick Shire boundary to the point where it intersects with the Creswick-Newstead Road, approximately 1.5 kms north-east of Cambelltown, thence through to Cambelltown via this road and then north-westerly on the Glengower Road for approximately 1.8 kms to the junction with an unnamed road that runs generally north-westerly across Middle Creek and then westerly around the northern end of Tullaroop Reservoir to its junction with the Carisbrook-Talbot Road, approximately 2 kms north-east of Craigie, thence northerly along this road to its junction with the Pyrenees Highway, which is then followed east for approximately 600 metres to its junction with the Carisbrook-Eddington Road, thence generally northerly for approximately 16 kms on this road to a Y junction with the Maryborough Road, thence south-westerly to the Y junction of the Maryborough Road and the Maryborough-Dunolly Road at Havelock, thence northwesterly on the Maryborough-Dunolly Road to where it is intersected by the Tullaroop Shire boundary north of Bet Bet township, thence via this Shire boundary to the point where it intersects with the Maryborough-Natte Yallock Road, thence westerly along this road to the Lower Homebush Road junction approximately 700 metres west of Rathscar, thence generally south and west to Lower Homebush settlement from where a straight line is taken west to a point where this line intersects with the Avoca-Bealiba Road, at approximately E.720500 N.5899500, thence northerly along the Avoca-Bealiba Road to where it is intersected by the Avoca Shire boundary, which is then followed generally westerly to where it is intersected by Redbank Creek, thence south-westerly along the creek to Redbank township, thence westerly on the Redbank to Barkly Road to the crossroads junction approximately 800 metres west of Barkly on the road from Frenchmans to Winjallock, thence generally northerly towards Winjallock to a point on this road, approximately E.696900 N.5910200, thence in a straight north-easterly line to the southern end of Teddington Reservoir, thence in a straight north-north westerly line across the middle of the Reservoir to the outlet point of the Reservoir on Strathfillan Creek, which is then followed downstream to the point where it is crossed by the road from Stuart Mill township to the Reservoir, thence northerly on this road to Stuart Mill on the Sunraysia Highway, thence northerly along the road from Stuart Mill through Carapoole to its insection with the Bendigo-St Arnaud Road, approximately 1 km west of Kooreh, thence westerly to the junction of the Sunraysia Highway and the Wimmera Highway in St Arnaud, thence south-westerly to Moolerr and southerly on the Navarre Road to Navarre township, thence generally southerly on the Ararat-St Arnaud Road to its junction with the Pyrenees Highway, which is then followed south-westerly to its junction with the Western Highway in Ararat, thence east from this junction for approximately 4 kms along the Western Highway to its intersection with the road to Ballyrogan, thence south-easterly through Ballyrogan and across the Eurambeen-Streatham Road to a Y junction at E.699400 N.584260, thence southerly to a T junction

approximately 4.2 kms west of Stockyard Hill, thence on the road that runs westerly then southerly towards the Glenelg Highway to the crossroads junction on the road between Tatyoon North and Skipton, thence generally south-easterly through Skipton and Mannibador to the T junction on the Cressy-Pittfield Road, approximately 600 metres east of Pittfield, thence southerly along the Cressy Road to Werneth, thence south-easterly along a straight unnamed road that intersects with the Colac-Ballarat Road, approximately 3.1 kms south of where the Werneth Road joins the Colac-Ballarat Road, which is then followed in a generally northerly direction through Rokewood and Dereel to the point where it is intersected by the Bunninyong Shire-Leigh Shire boundary, thence easterly along this boundary to where it intersects with the Meredith-Mt. Mercer Road, which is then followed in an easterly direction to Meredith, thence east-northerly-easterly along the road between Meredith and Burdidwarrah to its junction with the Geelong-Ballan Road at Burdidwarrah, thence south-easterly along this road to the Y junction with the road to Staughton Vale, which is followed through in a northerly direction to its junction with the Bacchus Marsh-Balliang Road, thence northerly along this road to its junction with the Geelong-Bacchus Marsh Road, which is then followed north through to its junction with the Bacchus Marsh-Gisborne Road, thence northerly along this road to the Y junction with the road to Trentham, approximately 3.5 kms north of Bullengarook, thence along this road to Trentham from where the Greendale-Trentham Road is followed generally south-west to the point where it is intersected by the Ballan Shire-Kyneton Shire boundary, thence generally westerly along this boundary to where it becomes the Ballan Shire-Daylesford and Glenlyon Shire boundary, thence westerly along this boundary to where it intersects with the Ballan-Daylesford Road, approximately 1.2 kms south of Leonards Hill, thence in a northerly direction along this road to its junction with Midland Highway in Daylesford, thereby completing the boundary.

Area 2: BENDIGO DJA DJA WRUNG ABORIGINAL ASSOCIATION INCORPORATED

The boundary commences at the junction of the Calder Highway and the Donald-Swan Hill Road at Dumosa, thence generally southerly along the Calder Highway to its junction with the Borung Highway at Charlton, thence southerly on the Charlton-St Arnaud Road to Coonooer, thence south-easterly along the straight road to Gowar East, from where the road south to Caropooee is followed to its intersection with the Bendigo-St Arnaud Road, approximately 1 km west of Kooreh, thence generally south-easterly along this road to Moliagul and continuing in this direction through to Dunolly, thence easterly on the Dunolly-Eddington Road to its junction with the Maryborough Road in Eddington, thence easterly along the Eddington-Maldon Road to its intersection with the Bridgewater-Maldon Road, thence south-easterly along the Bridgewater-Maldon Road to its Y junction with the Maldon-Newstead Road and the Castlemaine-Maldon Road, approximately 1.2 kms south of Maldon, thence generally south-easterly and easterly via the Castlemaine-Maldon Road and the Pyrenees Highway through Castlemaine to a junction approximately 900 metres east of Chewton. thence northerly through Golden Point to Faraday on the Calder Highway, which is then followed in a northerly direction to its junction with the McIvor Highway and Midland Highway in Bendigo, thence westerly via the Calder Highway to its junction with the Loddon Valley Highway, which is then followed in a northerly direction through Eaglehawk to its junction with the Bendigo-Pyramid Hill Road, thence northerly along this road to Mitiamo, thence north-westerly along the road to Pyramid Hill to where it crosses Bullock Creek, which is followed in a northerly direction to a point, approximately E.246000 N.600300 from where a direct northerly line is taken to intersect with the road to Terrick Terrick south of Granite Hill, thence westerly and northerly along this road to its junction with the Pyramid Hill-Leitchville Road, thence westerly to the junction with the Mincha Road in Pyramid Hill township, thence north-westerly to Mincha and westerly to Loddon Vale on the Loddon Valley Highway, which is followed north for approximately 1.5 kms to the junction with the road to Canary Island, thence westerly along this road to where it intersects with the Loddon River, which is then followed in a northerly direction to where it is crossed by the Murray Valley Highway after its junction with the Kerang-

Quambatook Road, approximately 1 km west of Kerang, thence generally westerly along this road to Quambatook, thence westerly along the Dumosa-Quambatook Road to its junction with the Donald-Swan Hill Road, which is then followed in a south-westerly direction to Dumosa, hereby completing the boundary.

Area 3: CAMP JUNGAI CO-OPERATIVE LTD.

Part A: The boundaries of the Camp Jungai property, which is located approximately 3 kms north-north-west of Rubicon township at approximately E.397700 N.5870850 and to which Camp Jungai Co-operative Ltd. holds legal title, set out in the Current Record Plan of Banyarmbite (B735) and noted as Vol. 8924 Folio 592 on the title of the land.

Part B: The boundary commences in Jamieson township at the junction of the Mansfield-Woods Point Road and the Heyfield-Jamieson Road, thence generally south-easterly along the Heyfield-Jamieson Road for approximately 40 kms to where it is joined by the Barkly River Road, thence along this road in an easterly direction for approximately 1.8 kms to where it is joined by the Barkly River fire track, which is then followed in a northerly direction to Rumffs Saddle, thence generally north-easterly and northerly along the continuation of this fire track, which leads over the summit of Mt. McKinty to the summit of Mt. Sunday, from which a straight northerly line is followed to the summit of Mt. McDonald, thence in a straight east-north-easterly line to the summit of Mt. Clear, thence in a straight north-north-easterly line to the summit of Mt. Howitt, thence in a straight northerly line to the summit of Mt. Buggery, thence in a straight northerly line to the summit of Mt. Speculation, thence in a straight north-easterly line to the summit of Mt. Selwyn, thence in a northerly direction along the fire track from this summit to Buckland Junction, thence northerly along the Buckland Valley Road to its junction with the Ovens Highway at Porepunkah, thence north-westerly along the Ovens Highway to its junction in Myrtleford with the Myrtleford-Yackandandah Road, which is then followed in a north-easterly direction to its junction with the Stanley Road, thence generally northerly along this road to its junction in Beechworth with the Buckland Gap Road, thence southerly along this road to its junction with the Ovens Highway, thence westerly along this highway to its junction with the Bowmans-Whorouly Road, which is then followed south-westerly to its junction in Whorouly with the Whorouly River Road, thence southerly along this road to its junction with the Bright Road, thence south-easterly along this road to its junction with the Carboor-Whorouly Road, which is then followed in a generally southerly direction to where it intersects with Carboor Creek, thence southerly along this creek to where it is crossed by Wrights Lane, which is followed generally westerly and northerly to Carboor Upper, thence south-westerly, westerly and then north-westerly along the road from Carboor Upper to Moyhu, thence westerly along the Glenrowan-Moyhu Road to its junction with the road to Hansonville, which is then followed in a westerly direction to its junction with the Wangaratta-Kilfeera Road, thence generally westerly along this road to its junction in Benalla with the Hume Highway, thence south-westerly along this highway to where it is intersected by the Warrenbayne Road, which is followed in a southerly and southeasterly direction, becoming the Swanpool-Warrenbayne Road after crossing the Benalla-Warrenbayne Road, through to its junction with the Midland Highway, thence southerly along this Highway, for approximately 2.3 kms to its junction with Lima Road, which is followed in a southerly direction through Lima, thence easterly along the Swanpool-Lima Road to its junction with the Midland Highway, approximately 700 metres south of Swanpool, thence northerly along this Highway to its junction with the Swanpool Road, thence easterly to Moorngag and then generally southerly through Samaria via Samaria Road, which connects with Sawyer Road, which is then followed in an easterly direction to its junction at Wrightley with the Tolmie Road, thence generally southerly and south-easterly along the Tatong-Tolmie Road to its junction at Toombullup with the Mansfield-Whitfield Road, which is then followed south-westerly to its junction with the road to Tolmie, thence south-westerly via Tolmie and Barwite to the Barwite turn-off on the Mansfield Road, thence approximately 1.5 kms west along this road to its junction with the Mansfield-Woods Point Road, which is then followed in a generally southerly direction to its junction with the Heyfield-Jamieson Road in Jamieson township, thereby completing the boundary.

Area 4: CENTRAL GIPPSLAND ABORIGINAL HEALTH AND HOUSING CO-OPERATIVE LTD.

The boundary commences at the Inverloch boat ramp, thence in a straight southerly line to the low-water mark on Point Smythe from where it follows the low-water mark in a generally easterly direction along the coast to the western head of Shallow Inlet, thence in a straight line to the eastern head of this inlet and continuing easterly along the low-water mark of Wilsons Promontory National Park to Entrance Point, including Shellback Island, Norman island, the islands of the Glennie Group and Answer Group, Wattle Island, Rabbit Rock and Rabbit Island, thence from Entrance Point in a straight easterly line to Townsend Point on Snake Island following the low-water mark to Clommel Banks at the eastern tip of this island, thence north-easterly across Port Albert Entrance, Kate Kearney Entrance and the entrance to Shoal Inlet, to the low-water mark on the western tip of McCloughlins Beach, thence easterly along the coast to the boat ramp at Seaspray, from where the Seaspray Road is followed in a northerly direction to its junction with the South Gippsland Highway, which is followed north to its junction with the Princes Highway in Sale, thence northerly along this Highway to its junction with the Maffra-Sale Road, thence north-westerly to Maffra and continuing northerly along the Maffra-Briagalong Road to its junction with the Bushy Park-Valencia Creek Road, which is followed in a generally northerly direction to where it terminates on Valencia Creek, thence northerly along this creek to its source at approximately E.499700 N.5847100, thence in a straight northerly line to a point on the Little River, at approximately E.499700 N.5851800, thence generally northerly along the Little River to its junction with the Moroka River, which is then followed in a north-westerly direction to its junction with the Wonnangatta River, thence continuing north-westerly up this river to its source at approximately E.469100 N.5889400, thence in a straight north-westerly line to the summit of Mt. Speculation, thence in a straight southerly line to the summit of Mt. Buggery, thence in a straight southerly line to the summit of Mt. Howitt thence in a straight south-south-westerly line to the summit of Mt. Clear, thence in a straight west-south-westerly line to the summit of Mt. McDonald, thence in a straight southerly line to Mt. Sunday, from where the fire track to the summit of Mt. McKinty is following in a southerly direction, thence from this summit the fire track is followed in a general southerly and south-westerly direction to Rumffs Saddle, thence southerly along the Barkly River Fire track to its junction with the Barkly River Road, which is followed in a generally westerly direction for approximately 1.8 kms to its junction with the Heyfield-Jamieson Road, thence in a straight south-south-westerly line to the northern boundary of the township of Sawmill Settlement on the Walhalla Road, thence in a southerly direction along the Walhalla Road to its junction with the Moe-Yallourn Road in Moe, thence easterly along this road to where it crosses Narracan Creek, thence southerly along this creek to where it is crossed by the road between Coalville and Narracan, thence southerly along this road through Narracan east to its junction with the Morwell-Thorpdale Road, which is followed in a westerly direction to the main cross roads in Thorpdale, from where the Mirboo North-Thorpdale Road is followed in a southerly direction to Mirboo North, thence generally north westerly along the Grand Ridge Road to its junction with the Leongatha-Mirboo Road, which is followed in a south-westerly direction to its junction with the Leongatha-Yarragon Road, thence continuing south-westerly along this road through Leongatha on the Inverlock-Leongatha Road to the boat ramp on the coast at Inverlock, thereby completing the boundary.

Area 5: ECHUCA ABORIGINAL CO-OPERATIVE LTD.

The boundary commences at the bridge where the Murray Valley Highway crosses the Loddon River, approximately 1 km west of Kerang, thence north-westerly along the Murray Valley Highway to its junction in Swan Hill with the Moulamein-Swan Hill Road, which is followed east, to the bridge over the Murray River, thence generally south-easterly along the Victoria—New South Wales border to where it is intersected by the Cohuna Shire—Rochester Shire boundary, which is followed generally northwesterly and southerly to its intersection with the Murray Valley Highway, thence northwesterly on this highway to its junction with the Leitchville Road, which is then followed

north-westerly for approximately 5 kms to its junction with the Pyramid-Leitchville Road, thence generally south-westerly along this road to Pyramid Hill township, thence north-westerly to Mincha and westerly to Loddon Vale on the Loddon Highway, which is then followed north for approximately 1.5 kms to the junction with the road to Canary Island, thence westerly along this road to where it intersects with the Loddon River, which is then followed in a northerly direction to where it is crossed by the Murray Valley Highway, thereby completing the boundary.

Area 6: FAR EAST GlPPSLAND ABORIGINAL CORPORATION

The boundary commences approximately 900 metres west of Pearl Point where the road from Bemm River township terminates on the coast, thence east-north-easterly along this road to its junction in Bemm River with the Sydenham Inlet Road, which is then followed north-westerly to its junction with the Princes Highway, thence easterly along this Highway to where it crosses the Bemm River, which is then followed in a northerly direction to its junction with the Goolengook River, thence generally north-northwesterly up the Goolengook River to a point approximately E.661950 N.585500 from where a straight north-westerly line is taken across the summit of Mt. Ellery to the southern boundary of Goongerah township on the Bonang Highway, thence northerly along this highway to its junction with the Bendoc-Orbost Road, which is then followed in a north-easterly direction to its junction in Bendoc with the road to Haydens Bog township, thence along this road to the Victoria-New South Wales border, thence southeasterly to Cape Howe, from where the low-water mark is followed in a generally westerly direction, including within the boundary Gabo Island and Tullaberga Island, across the tidal sand bar at the entrance to Mallacoota Inlet and in a straight westerly line across the entrances to Wingan Inlet, Tamboon Inlet and Sydenham Inlet, thence westerly to approximately 900 metres west of Pearl Point where the road from Bemm River township terminates on the coast, thereby completing the boundary.

Area 7: GIPPSLAND AND EAST GIPPSLAND ABORIGINAL CO-OPERATIVE LTD.

The boundary commences approximately 7.5 kms north of Anglers Rest at the junction of the Bogong High Plains Road and the Omeo Highway, thence south-easterly along this Highway to its junction with the Swifts Creek-Omeo Road, which is then followed generally south-easterly to its junction in Swifts Creek township with the Omeo Highway, thence south-easterly on this Highway to where it crosses the Tambo River approximately 200 metres east of Ensay South, thence generally southerly along this river to where it is bridged by the Bruthen-Buchan Road, approximately 300 metres south-east of Bruthen township, thence north-westerly to the junction in Bruthen of the Bruthen-Buchan Road and the Omeo Highway, thence westerly along this highway through Wiseleigh to its junction with the road to Mossiface, thence generally southerly along this road to its junction in Johnsonville with the Princes Highway, which is followed easterly to its junction with the Metung Road, thence southerly along this road through Metung to the low-water mark at Shaving Point on the northern coast of Lake King, thence generally easterly along this northern coast to where the Princes Highway bridges North Arm in Lakes Entrance, thence across this bridge to the eastern shore of North Arm, thence south-easterly around the coast to the Bullock Island Road bridge, thence southwesterly across this bridge, thence westerly and then south-easterly around the western shore of Bullock Island to its south-western tip, thence in a straight south-south-easterly line across the entrance of Cunninghame Arm to the northern tip of the eastern shore of the entrance to Lake King, which is then followed south-south-easterly to the low-water mark on the southern tip of this entrance on Ninety Mile Beach, thence in a straight westerly line across the entrance to Lake King and continuing in a generally westerly direction at low-water mark along Ninety Mile Beach to the boat ramp at Seaspray, thence northerly along the Seaspray Road to its junction with the South Gippsland Highway, which is followed north to its junction with the Princes Highway in Sale, thence northerly along this highway to its junction with the Maffra-Sale Road, thence north-westerly to Maffra and continuing northerly along the Maffra-Briagalong Road to its junction with the Bushy Park-Valencia Creek Road, which is followed in a

generally northerly direction to where it terminates on Valencia Creek thence northerly along this creek to its source at approximately E.499700 N.3747100. thence in a straight northerly line to a point on the Trapyard Hill Road at approximately E.495500 N.374500, thence generally north-easterly to the point where this road crosses the Moroka River, at approximately E.495900 N.376500, which is then followed in a north-north-westerly then north-easterly direction to its junction with the Wannangatta River, thence continuing north-westerly up this river to its source at approximately E.469100 N.5889400, thence in a straight north-westerly line to the summit of Mt. Speculation, thence in a straight north-easterly line to the summit of Mt. Selwyn, thence in a straight east-north-easterly line to the summit of Mt. St. Bernard, thence via a straight northeasterly line to the summit of Mt. Hotham, thence in a straight north-easterly line to the summit of Mt. Loch, thence in a straight north-easterly line to the summit of Mt. Jim, thence in a straight easterly line to Mt. Bundara, thence in a straight easterly line to the summit of Mt. Cope, thence along a straight north-easterly line towards the summit of Basalt Hill to where this line intersects the Bogong High Plains Road at approximately E.525900 N.5914100, thence generally easterly along this road to its junction with the Omeo Highway, thereby completing the boundary.

With the exclusion of the property belonging to the Camp Jungai Co-operative Limited, which is surrounded by the community area of the Healesville and District Aboriginal Co-operative Limited, being located approximately 3 kms north-north-west of Rubicon township at approximately E.397700 N.5870850 with the boundaries for this property being set out in the current record plan of Banyarmbite and noted as Vol. 8924 Folio 592 on the title of the land, and with the exclusion also of the area located to the south of Healesville township specified as being of 4850 acres in total set aside for the Coranderrk Aboriginal Reserve, as shown on the map of subdivision dated 15 August 1892, which is map number C166 (2) held by the Lands Division of the Victorian Department of Conservation. Area 10: KERRUP-JMARA ELDERS ABORIGINAL CORPORATION.

The boundary commences at the low-water mark on the South Australia-Victoria border at the western end of Discovery Bay, thence generally south-easterly and easterly along the coast, including Lawrence Rocks off Point Danger, past Portland to the point where the Portland Shire-Belfast Shire boundary intersects with the coast, thence northerly along this boundary to where it intersects with the Princes Highway, thence east-southeasterly along this Highway for approximately 3.5 kilometres to its junction with the road to Bessiebelle, which is then followed northerly and north-easterly to where it bridges the Eumeralla Creek, thence generally northerly along this Creek to where it is crossed by the Hamilton-Port Fairy Road in the township of MacArthur, thence northeasterly along the MacArthur-Hawksdale Road for approximately 900 metres to its junction with the MacArthur-Penshurst Road, which is then followed north-easterly for approximately 6 kilometres to a Y junction with an unnamed road, which is followed in a northerly direction to a T junction approximately 6.9 kilometres east of the township of Byaduk, thence from this T junction in a straight north-north-easterly line to the summit of Mount Napier, thence in a straight north-north-easterly line to the junction of the road from Branxholm and the Mount Napier Road in the township of Buckley Swamp, thence north-north-westerly for approximately 2.5 kilometres along the Mount Napier Road to its junction with an unnamed road, which is followed in an easterly then northerly direction to its junction with the Hamilton Highway, approximately 2.7 kilometres east of Tarrington, thence westerly to Tarrington, thence northerly along the road to Strathkellar to where it is intersected by the Glenelg Highway, thence northeasterly along this Highway to its junction in Dunkeld with the Victoria Valley Road, which is followed in a generally northerly and easterly direction to its junction with the Mount Abrupt-Grampians Road, thence northerly along the Grampians Road to where it is intersected by the Stawell Shire-Ararat Shire boundary, thence westerly along this boundary to where it joins with the Dundas Shire/Arapiles Shire boundary, which is then followed generally north-westerly across the Serra Range to the point approximately 800 metres east of the Glenelg River where it intersects with the road running southwesterly and then north-westerly to the township of Woohlpooek, thence along this road to Woohlpooek, which is on the Henty Highway, thence generally northerly and north-

easterly along this highway for approximately 6.7 kilometres to where it bridges Salt Creek, thence north-westerly along this creek to where it intersects with the southern shore of the Rocklands Reservoir, which is then followed in a generally south-westerly then north-westerly direction to the south-western end of the Rocklands Dam wall, where the Wannon Shire-Kowree Shire boundary intersects with it, thence generally westerly, then north-north-easterly, then westerly along this Shire boundary to where it intersects at Harrow with the Harrow-Horsham Road, thence northerly along this road for approximately 1.1 kilometres to its junction with the Coleraine-Edenhope Road, which is then followed west-north-westerly to its junction with the Wimmera Highway, thence generally westerly along this Highway through Edenhope to where it intersects with the Victoria-South Australia border, thence southerly along this border to where it intersects with the low-water mark at the western end of Discovery Bay, thereby completing the boundary.

Area 11: LAKE TYERS ABORIGINAL TRUST.

The boundary commences at the boat ramp in the Lake Tyers township on the western side of the entrance to Lake Tyers itself, thence generally north-westerly along the Lake Tyers Road to its junction with the Princes Highway which is then followed north-north-easterly to Nowa Nowa, thence easterly along the Princes Highway to its crossing of the Snowy River, thence generally south-easterly along the eastern bank of the Snowy River to the low-water mark at the mouth of this river on Ninety Mile Beach, approximately 500 metres west of Marlo township, thence in a straight westerly line across the mouth of the Snowy River, thence continuing generally westerly at low-water mark along Ninety Mile Beach to the eastern point of the entrance to Lake Tyers, from where a straight westerly line is followed to the boat ramp in the Lake Tyers township, thereby completing the boundary.

Area 12: LAKES ENTRANCE ABORIGINAL CORPORATION LTD.

The boundary commences at the point where the Snowy River is crossed by the Bruthen-Buchan Road, approximately 300 metres south-east of Bruthen township, thence northwesterly to the junction in Bruthen of the Bruthen-Buchan Road and the Omeo Highway, thence westerly along this highway through Wiseleigh to its junction with the road to Mossiface, thence generally southerly along this road to its junction in Johnsonville with the Princes Highway, which is followed in an easterly direction to its junction with the Metung Road, thence southerly along this road through Metung to the low-water mark at Shaving Point on the northern coast of Lake King, thence generally easterly along this northern coast to where the Princes Highway bridges North Arm in Lakes Entrance, thence across this bridge to the eastern shore of North Arm, thence southeasterly around the coast to the Bullock Island Road bridge, thence south-westerly across this bridge, thence westerly and then south-easterly around the western shore of Bullock Island to its south-western tip, thence in a straight south-south-easterly line across the entrance of Cunninghame Arm to the northern tip of the eastern shore of the entrance to Lake King, which is then followed south-south-easterly to the low-water mark on the southern tip of the entrance on Ninety Mile Beach, thence generally easterly along Ninety Mile Beach to the boat ramp in the Lake Tyers township on the western side of the entrance to Lake Tyers, thence generally north-westerly along the Lake Tyers Road to its junction with the Princes Highway, which is followed north-north-easterly to its junction in Nowa Nowa with the Red Knob Road, thence north-westerly along this road to its junction with the Bruthen-Buchan Road, which is then followed generally westerly to where this road crosses the Snowy River, thereby completing the boundary.

The boundary commences at the point where the Tallangatta Shire-Omeo Shire boundary intersects with the Omeo Highway, approximately 7.2 kms north of Sunnyside township, thence generally southerly and south-easterly along the Omeo Highway to its junction with the Swifts Creek-Omeo Road, which is then followed generally south-easterly to its junction in Swifts Creek township with the Omeo Highway, thence south-easterly on this Highway to where it crosses the Tambo River, approximately 200 metres east of

Pinnibar, thence in a straight south-southwesterly line to the summit of Mt. The boundary commences in Ouyen at the junction of the Ouyen Highway and the Calder Highway, thence northerly along the Calder Highway to the point where the north-western corner of the boundary of the Hattah-Kulkyne National Park co-incides with the Calder Highway, thence generally easterly along the northern boundary of this National Park to its north-eastern corner where it co-incides with the road from Coolignan to Kulkyne township, thence south-easterly along this road into Kulkyne to the Victoria-New South Wales border on the southern bank of the Murray River, thence generally south-easterly along the Victoria-New South Wales border to where it co-incides with the junction of the Murray Valley Highway and the Ouyen-Piangil Road, thence westerly along the Ouyen-Piangil Road to its junction in Ouyen with the Calder Highway, thereby completing the boundary.

The boundary commences at the point where the Victoria-South Australia border intersects with the Ouyen Highway, thence easterly along this highway to its junction in Ouyen with the Calder Highway, thence northerly along the Calder Highway to the point where the north-western corner of the boundary of the Hattah-Kulkyne National Park coincidences with the Calder Highway, thence generally easterly along the northern boundary of this National Park to its north-eastern corner where it coincides with the road from Coolignan to Kulkyne township, thence south-easterly along this road into Kulkyne to the Victoria-New South Wales border on the southern bank of the Murray River, thence in a generally northerly and westerly direction along this border to its intersection with the Victoria-South Australia border, thence southerly along the Victoria-South Australia border to the point where it intersects with the Ouyen Highway, thereby completing the boundary.

The boundary commences at the bridge where the Murray Valley Highway crosses the Loddon River, approximately 1 km west of Kerang, thence north-westerly along the Murray Valley Highway to its junction in Swan Hill with the Moulamein-Swan Hill Road, which is followed easterly to the bridge over the Murray River, thence generally north-westerly along the Victoria-New South Wales border to where it coincides with the junction of the Murray Valley Highway and the Ouyen-Piangil Road, thence westerly along the Ouyen-Piangil Road to its junction in Ouyen with the Calder Highway, thence southerly along this highway to its junction with the Sunraysia Highway, thence southeasterly along this highway to its junction in Birchip with the Birchip-Wycheproof Road, which is then followed in an easterly direction to its junction with the road to Carapugna, approximately 1.6 kms east of Narraport, thence generally easterly along this road through Carapugna to its junction with the Donald-Swan Hill Road, which is then followed north-easterly through Dumosa and Towaninny to its junction with the Dumosa-Quambatook Road, thence generally easterly and east-north-easterly to its junction with the Murray Valley Highway where it crosses the Loddon River, thereby completing the boundary.

The boundary commences in Leongatha at the junction of the South Gippsland Highway and the Leongatha-Yarragon Road, which is followed in a generally northerly direction to its junction with the Princes Highway, thence generally north-north-westerly along the Yarragon-Shady Creek Road to the point approximately 3.5 kms east of Buln Buln East where it is intersected by the Warragul Shire-Narracan Shire boundary, thence northerly along this boundary to its intersection with the Buln Buln Shire boundary, thence northerly along the Buln Buln Shire-Narracan Shire boundary to where it intersects with Shady Creek, approximately 2.9 kms north of the summit of Springsure Hill, thence generally north-westerly along Shady Creek to where it is crossed by the Neerim East Road, which is then followed north-westerly to its junction with the Main Neerim Road, thence southerly to the junction in Neerim of the Main Neerim Road and the road which runs along the crest of the Blue Range, thence generally westerly along the road on the Blue Range, to the point, approximately 2.1 kms west-south-west of the summit of Dick Hill, where this road intersects with the junction of the Buln Buln Shire-Pakenham Shire-Upper Yarra Shire boundary, thence southerly along the Buln Buln Shire-Pakenham Shire boundary, which is the Bunyip River, to where it intersects with the Nar Nar Goon-Longwarry Road, approximately 1.3 kms east of Bunyip, thence easterly along this road to its junction in Longwarry township with the Longwarry-Drouin Road, thence easterly and south-easterly along this road to its junction in Drouin with the Main South Road, which is followed in a generally southerly direction to its junction with the Poowong-Ranceby Road, thence easterly along the Poowong-Ranceby Road to its junction in Ranceby with the Korumburra-Warragul Road, thence generally southerly along this road to its junction with the South Gippsland Highway in Korumburra, thence generally south-easterly along this highway to its junction with the Leongatha-Yarragon Road in Leongatha, thereby completing the boundary.

The boundary commences in Leongatha at the junction of the South Gippsland Highway and the Inverlock-Leongatha Road, thence south-westerly along this road to the low-water mark on the boat-ramp in Inverlock township, thence generally westerly along the coast to where it is intersected by the Phillip Island Road Bridge, which is then followed across the Narrows to Phillip Island where the low-water mark is followed generally south-easterly and then westerly to Point Grant, including Pyramid Rock, the Nobbies and Seal Rock, thence from Point Grant in a straight west-north-westerly line across the entrance to Western Port to West Head, thence generally westerly to Cape Schank, including Pulpit Rock, thence north-westerly to Point Nepean, thence in a straight east-north-easterly line to the low-water mark on the south-west tip of the northern island of the Mud Island group, thence in a straight north-north-westerly line to the south point of the mouth of the Werribee River, which is then followed generally north-westerly to the eastern end of the Melton Reservoir, thence north-westerly along the northern shore of this reservoir to its western end, thence westerly along the Werribee River to where it is crossed by the Geelong-Bacchus Marsh Road, thence northerly along this road to its junction in Bacchus Marsh with the Bacchus Marsh-Gisborne Road, thence northerly along this road to the Y junction with the road to Trentham, approximately 3.5 kms north of Bullengarook, thence along this road to Trentham, from where the Greendale-Trentham Road is followed generally southwesterly to the point where it is intersected by the Ballan Shire-Kyneton Shire boundary, thence generally westerly along this boundary to where it becomes the Ballan Shire-Daylesford and Glenlyon Shire boundary, thence westerly along this boundary to where it intersects with the Ballan-Daylesford Road, approximately 1.2 kms south of Leonards Hill, thence in a northerly direction along this road to its junction with the Midland Highway in Daylesford, thence north-easterly along this Highway to its junction with the Malmsbury-Daylesford Road which is then followed north-easterly to its junction in Denver with the road to Spring Hill, thence south-easterly along this road to the settlement of Spring Hill, thence in a direct north-westerly line to the junction of the Calder Highway and the Redesdale Road in Kyneton, thence northerly along the Redesdale Road to its junction on the northern boundary of Kyneton township with the road to Pipers Creek, thence easterly along this road to its junction with the road leading to Sidonia and Pastoria East, thence north-easterly along this road to the Y junction of the road to Sidonia and the road to Pastoria East, thence easterly along the road through Pastoria East to its junction with the road from Pipers Creek to Baynton, thence north-easterly along this road to Baynton, thence generally easterly along the road to Emu Flat, thence generally easterly along the road to Pyalong, thence easterly along the road to Glenaroua, thence generally east-north-easterly along the road to Tallarook to its junction with the road to Hilldene, approximately 8.2 kms west of Tallarook, thence north-easterly from this junction along the road to Hilldene, to its junction with the Seymour-Tooborac Road, which is then followed east to where it is crossed by the Hume Freeway, thence southerly along this freeway to where it crosses the road from Glenaroua to Tallarook, thence easterly along this road to its junction in Tallarook with the Upper Goulbourn Road, which is then followed in an easterly direction to its junction with the Goulburn Valley Highway in Trawool township, thence north-westerly to the junction of this Highway and the Highlands Road in Seymour, thence easterly along the Highlands Road to its junction with the road to the settlement of Tarcombe, approximately 18.2 kms west of the settlement of Highlands, thence northeasterly along the road through to Tarcombe, thence generally north-north-easterly along the road to Old Longwood settlement to where it is joined by the road leading through to Terip Terip, this junction being approximately 2.6 kms south-east of Old Longwood, thence generally easterly along the road to Terip Terip for approximately 3.3 kms to its junction with the road between Terip Terip and Creightons Creek, thence northerly along this road through Creightons Creek township to a cross-roads junction, approximately 2.5 kms north of this township, thence in an easterly direction along the road from Old Longwood to its junction with the Euroa-Mansfield Road, thence in a

straight north-easterly line from this junction to the northern boundary of the settlement of Sheans Creek on the Euroa-Strathbogie Road, thence generally north-easterly along an unnamed road past its junction with the road to Balmattum to the north and past its junction with the road to Marraweeny to the south-east, and continuing northeasterly on this road to where it terminates on the south-side of the Hume Highway road reservation, approximately 2.5 kms south-west of the junction of this Highway and the Harrys Creek Road, thence north-westerly along the Hume Highway to where it is intersected by the Warrenbayne Road, which is followed in a southerly and southeasterly direction, becoming the Swanpool-Warrenbayne Road after crossing the Benalla-Warrenbayne Road, through to its junction with the Midland Highway, thence southerly along this highway for approximately 2.3 kms to its junction with Lima Road, which is followed in a southerly direction through Lima, thence easterly along the Swanpool-Lima Road to its junction with the Midland Highway, approximately 700 metres south of Swanpool, thence northerly along this highway to its junction with the Swanpool Road, thence easterly to Moorngag and generally southerly through Samaria via Samaria Road, which connects with Sawyer Road, which is then followed in an easterly direction to its junction at Wrightley with the Tolmie Road, thence generally southerly and southeasterly along the Tatong-Tolmie Road to its junction at Toombullup with the Mansfield-Whitfield Road, which is then followed south-westerly to its junction with the road to Tolmie, thence south-westerly via Tolmie and Barwite to the Barwite turn-off on the Mansfield Road, thence approximately 1.5 kms west along this road to its junction with the Mansfield-Woods Point Road, which is then followed in a generally southerly direction to its junction in Jamieson township with the Heyfield-Jamieson Road, thence generally south-easterly along the Heyfield-Jamieson Road for approximately 40 kms to its junction with the Barkely River Road, thence in a straight southerly line to the summit of Mt. Shillinglaw, thence in a straight southerly line to the summit of Mt. Singleton, thence in a straight south-south westerly line to the northern boundary of the Sawmill Settlement township on the Walhalla Road, which is followed in a southerly direction to its junction with the Moe-Yallourn Road in Moe, thence easterly along this road to where it crosses Narracan Creek, thence southerly along this creek to where it is crossed by the road between Coalville and Narracan, thence southerly along this road through Narracan East to its junction with the Morwell-Thorpdale Road, which is then followed in a westerly direction to the main cross-roads in Thorpdale, from where the Mirboo North-Thorpdale Road is followed in a southerly direction to Mirboo North, thence generally north-westerly along the Grand Ridge Road to its junction with the Leongatha-Mirboo Road, which is then followed in a south-westerly direction to its junction with the Leongatha-Yarragon Road, thence generally northerly along the Leongatha-Yarragon Road to its junction with the Princes Highway, thence generally north-north-westerly along the Yarragon-Shady Creek Road, to the point, approximately 3.5 kms east of Buln Buln East, where it is intersected by the Warragul Shire-Narracan Shire boundary, thence northerly along this boundary to its intersection with the Buln Buln Shire boundary, thence northerly along the Buln Buln Shire-Narracan Shire boundary to where it intersects with Shady Creek, approximately 2.9 kms north of the summit of Springsure Hill, thence generally north-westerly along Shady Creek to where it is crossed by the Neerim East Road, which is then followed north-westerly to its junction with the Main Neerim Road, thence northerly along this road to its junction with the Yarra Junction-Noojee Road, thence easterly to the junction in Noojee of the Mount Baw Baw Road and the Loch Valley Road, thence generally northerly along the Loch Valley Road, through the settlements of Loch Valley and Toorongo to the junction of this road and the Warburton-Woods Point Road, which is then followed in an easterly direction to its junction in Matlock with the Mansfield-Woods Point Road, thence generally northerly along this road to the northern boundary of the township of Gaffneys Creek, thence in a straight north-westerly line to the southern boundary of the township of Enoch Point, thence north-north-westerly along the Enoch Point Road to its junction with the Eildon-Jamieson Road which is then followed generally westerly to its junction with Dry Creek Road, which is approximately 3.1 kms east-north-east of the summit of Mt. southern boundary of Rubicon township, thence north-westerly along the road through Rubicon to its junction with the Taggerty-Thornton Road, which is then followed generally westerly to where it crosses the Acheron River, on the eastern boundary of Taggerty township, thence northerly along the Acheron River to its junction with Connelly Creek, thence southerly along this creek for approximately 600 metres to where it is crossed by the Maroondah Highway, approximately 200 metres north of the Acheron township boundary, thence southerly along this Highway to its junction in Acheron with the road along Connelly Creek, which is followed south-westerly for approximately 8.2 kms to a Y junction at approximately E.381300 N.5868900, thence generally north-westerly along an unnamed road for approximately 15.3 kms to its junction with the road to Molesworth, approximately 150 metres east of the bridge over Scrubby Creek on the Molesworth Road, thence in a straight south-westerly line from this junction to the cross-roads junction in the settlement of Limestone, thence northwesterly along the road that leads through Cheviot and joins the Goulburn Valley Highway, approximately 1.6 kms east of Yea, thence westerly along this Highway through Yea to its junction with the Whittlesea-Yea Road, which is then followed generally south-westerly, through Flowerdale and Kinglake West, to its junction in Whittlesea with the Wallan-Whittlesea Road, thence northerly along this road for approximately 1.2 kms to its junction with the road to Eden Park, thence westerly along this road through Eden Park to its junction with the road between Woodstock and Merriang, thence southerly along the road through Woodstock where it becomes the Epping Road and continuing south along the Epping Road to its junction in Epping with Rufus Street, thence easterly and north-easterly along Rufus Street to its junction with McDonalds Road, which is followed east to Morang South where it joins Gorge Road, thence easterly along Gorge Road to where it crosses the Plenty River and becomes Kurrak Road, thence continuing generally easterly along Kurrak Road to its junction with Yan Yean Road, which is then followed south to its junction with Diamond Creek Road, thence generally easterly along this road to the point where it crosses Diamond Creek, thence southerly along this creek to where it is crossed by Main Road in Eltham, thence south-westerly along this road for approximately 1.2 kms to its junction with Fitzsimons Lane, which is then followed in a southerly direction to its junction with Williamsons Road, thence southerly along this road to its junction with Doncaster Road, which is then followed in an easterly direction to where it becomes Mitcham Road, which is then followed south-easterly to its junction with the Maroondah Highway, thence generally north-easterly along this Highway to its junction with Dorset Road, which is then followed south to its junction with the Burwood Highway, thence easterly along this Highway to its junction with the Mt. Dandenong Tourist Road and Monbulk Road, thence east-south-easterly along Monbulk Road to its junction in Belgrave with the Belgrave-Gembrook Road, thence generally easterly along this road to its junction in Emerald with the Beaconsfield-Emerald Road, thence generally south-south-easterly along this road for approximately 5.2 kms to the junction of an unnamed road, which is then followed in an easterly and southerly direction to its junction in Pakenham Upper with the Healesville-Gembrook Road, thence generally northerly along this road to its junction in Gembrook with the road to Tonimbuk, thence easterly along this road for approximately 1.8 kms to a Y junction, thence along the unnamed northerly bearing road that leads from this junction up to Mt. Beenak for approximately 3.2 kms to its junction with the unnamed road that leads in an easterly direction along Back Creek at the base of the northern fall of the Black Snake Range, thence easterly along this road for approximately 1.3 kms to where it first crosses Back Creek, thence generally easterly along Back Creek itself to where it intersects with the Buln Buln Shire-Pakenham Shire Boundary, which is the Bunyip River, thence southerly along this boundary to where it intersects with the Nar Nar Goon-Longwarry Road, approximately 1.3 kms east of Bunyip, thence easterly along this road to its junction in Longwarry township with the Longwarry-Drouin Road, thence easterly and south-easterly along this road to its junction in Drouin with the Main South Road, which is then followed in a generally southerly direction to its junction with the Poowong-Ranceby Road, thence easterly along the Poowong-Ranceby Road to its junction in Ranceby with the
