This instrument repeals the twelve Jervis Bay Territory Public Health Emergency Declarations made between 2020 and 2022 which declared, extended and further extended the public health emergency period in Jervis Bay Territory during COVID-19.

Public Health (Jervis Bay Territory) (Emergency Declaration) Repeal Instrument 2023

 

I, DAVID MACKAY, Deputy Secretary, Regions, Cities and Territories Group, Department of Infrastructure, Transport, Regional Development, Communications and the Arts, exercising powers vested in me under the direction, dated 16 April 2020, made by the Governor-General under subsection 4B(2) of the Jervis Bay Territory Acceptance Act 1915 (Cth), make the following instrument.

1  Name

                   This instrument is the Public Health (Jervis Bay Territory) (Emergency Declaration) Repeal Instrument 2023.

2  Commencement

                   This instrument commences on the day after it is registered.

Note:          The Public Health (Jervis Bay Territory) Emergency Declaration 2020 ceased to be in force on 12 January 2023.    

3  Authority

                   This instrument is made under section 119 of the Public Health Act 1997 (ACT), as in force in the Jervis Bay Territory under section 4A of the Jervis Bay Territory Acceptance Act 1915 (Cth).

Note:          Subsection 46(1) of the Legislation Act 2001 (ACT), as in force in the Jervis Bay Territory under section 4A of the Jervis Bay Territory Acceptance Act 1915 (Cth), provides the power to make a statutory instrument under an Act includes the power to repeal a statutory instrument.

4  Repeal of emergency declaration instruments

                   Each instrument that is mentioned in Schedule 1 is repealed.
