The instrument amends the ASIC Corporations (Registration of Relevant Providers) Instrument 2023/490 and further extends the delay to the requirement for relevant providers to be registered with ASIC as a precondition for providing personal advice to retail clients about relevant financial products to 1 February 2024. The instrument allows extra time for amendments to be made to the registration provisions which will improve the operation of stage 1 of the registration process. This will benefit both AFS licensees and financial advisers.

Part 1—Preliminary

1        Name of legislative instrument

This is the ASIC Corporations (Amendment) Instrument 2023/730.

2        Commencement

This instrument commences on the day after it is registered on the Federal Register of Legislation.

Note:    The register may be accessed at www.legislation.gov.au.

3        Authority

This instrument is made under paragraph 926A(2)(a) of the Corporations Act 2001.

4        Schedule

Each instrument that is specified in the Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in the Schedule to this instrument has effect according to its terms.

1        Sections 5 and 7

Omit “1 October 2023” (wherever occurring), substitute “1 February 2024”.
