1  Name

                   This instrument is the Road Vehicle Standards (Model Reports—Compliance with Standards) Amendment (2023 Measures No. 1) Determination 2023.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

                   This instrument is made under subsection 89(2) of the Road Vehicle Standards Rules 2019.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1Amendments

Road Vehicle Standards (Model Reports—Compliance with Standards) Determination 2021

1  Schedule 1 (table item 10, column 2, paragraph (e))

Omit “unless”, substitute “where”.

2  Clause 6 of Schedule 3

Repeal the clause.

3  Clause 7 of Schedule 3

Before “The following”, insert “(1)”.

4  Paragraph 7(c) of Schedule 3

After “passenger vehicles,”, insert “or goods vehicles with a gross vehicle mass of 3.5 tonnes or less—”.

5  Paragraph 7(c) of Schedule 3

After “in accordance with”, insert “a test method described in”.

6  Paragraph 7(d) of Schedule 3

Omit “passenger vehicles,”, substitute “vehicles of a kind referred to in paragraph (c)—”.

7  At the end of clause 7 of Schedule 3

Add:

             (2)  Paragraphs (1)(c) and (1)(d) do not apply to the converted vehicle where:

                     (a)  the steering ratio of the converted vehicle, determined by measuring the swept steering angle of the steered wheels as a function of the angular displacement of the steering control throughout the full steering range, is within a tolerance of ± 5 per cent of that of the original vehicle; and

                     (b)  an electronic functional check shows that the steering and electronic stability control systems are functioning correctly throughout the full steering range of the converted vehicle.

             (3)  In this clause:

goods vehicle has the meaning given by section 239 of the Rules.

passenger vehicle has the meaning given by section 239 of the Rules.

8  Subclause 10(2) of Schedule 3

Repeal the subclause.

9  Subclause 10(3) of Schedule 3

Omit “the test mentioned in subclause (2)”, substitute “the analysis of the integrity of the vehicle structure of the converted vehicle referred to in subsection 32(1)”.

10  At the end of subclause 10(3) of Schedule 3

Add:

Note:          Subsection 32(1) and paragraph 32(1)(b) require a conversion design for a converted vehicle to set out an analysis of the integrity of the structure of the vehicle addressing the shape of its structure, including its symmetry.

11  Subclause 10(6) of Schedule 3

Repeal the subclause, substitute:

             (6)  For the purposes of paragraph 89(2)(b) of the Rules, the Secretary may only be satisfied that a converted vehicle complies with the requirement in subclause (5) where the airbag is deployed (whether inside or outside the vehicle) to demonstrate that modifications made to the airbag mounting and brackets, dash pad and panels, and airbag exit points, will not cause injury.

12  At the end of clause 10 of Schedule 3

Add:

             (7)  For the purposes of subclause (6), an airbag will be taken to have been deployed as required by that subclause only where all of the following requirements are met:

                     (a)  where the airbag is deployed outside the vehicle—the airbag is deployed on a mount consisting of a completed dashboard design that corresponds with the dashboard design of the relevant vehicle and that is fitted with the airbag covering material;

                     (b)  the airbag is deployed in a way that activates all stages of the airbag (where applicable);

                     (c)  the airbag is deployed in the most rapid way designed by the original manufacturer;

                     (d)  the deployment of the airbag is recorded with sufficient clarity to enable an accurate assessment the potential for injury arising from that deployment.

             (8)  In this clause:

passenger airbag means an airbag mounted for the protection of the head, torso, or both the head and torso, of a front row passenger of the vehicle (other than the driver of the vehicle), and does not include any lower knee bolster or side airbags.
