This instrument removes multiple instances of requirements in the Space (Launches and Returns) (General) Rules 2019 and Space (Launches and Returns) (High Power Rocket) Rules 2019 that a suitably qualified expert or person with suitable qualifications and experience must ‘not be a related party of’, and in one instance must ‘be independent of’, an applicant.

1  Name

                   This instrument is the Space (Launches and Returns) Legislation Amendment (Suitably Qualified Experts) Rules 2023.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

                   This instrument is made under the Space (Launches and Returns) Act 2018.

Omit “an independent person”, substitute “a person”.

2  Paragraph 52(2)(a)

Omit “and is not a related party of the applicant”.

3  Subsection 53(3)

4  Subsection 56(3)

Omit “who is not a related party of the applicant”.

5  Paragraph 98(2)(a)

Omit “and is not a related party of the applicant”.

6  Subsection 99(3)

Omit “and is not a related party of the applicant”.

7  Subsection 102(3)

Omit “who is not a related party of the applicant”.

125  Application of amendments made by the Space (Launches and Returns) Legislation Amendment (Suitably Qualified Experts) Rules 2023

             (1)  The amendments made to this instrument by the amending instrument apply to:

                     (a)  applications made on or after the day the amending instrument commences; and

                     (b)  applications made, but not finally determined, before the day the amending instrument commences.

             (2)  For the purposes of this section, the amending instrument is the Space (Launches and Returns) Legislation Amendment (Suitably Qualified Experts) Rules 2023.

9  Subsection 26(3)

Omit “and is not a related party of the applicant”.

10  Subsection 29(3)

Omit “who is not a related party of the applicant”.
