This instrument amends the Royal Commissions Regulations 2019 to maintain consistency with the Royal Commissions Act 1902 (the Act) by making clear that royal commission records containing information to which section 6OQ of the Act applies cannot be disclosed for the purposes of law enforcement except in specified circumstances. The instrument also amends the definition of ‘Defence and Veteran Royal Commission’ in the Regulations, to maintain consistency with the Act.

1  Name

                   This instrument is the Royal Commissions Amendment (Enhancing Engagement) Regulations 2023.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this instrument

The later of:

(a) the start of the day after this instrument is registered; and

(b) immediately after the commencement of Schedule 1 to the Royal Commissions Amendment (Enhancing Engagement) Act 2023.

However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur.

 

Note:          This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.

             (2)  Any information in column 3 of the table is not part of this instrument. Information may be inserted in this column, or information in it may be edited, in any published version of this instrument.

3  Authority

                   This instrument is made under the Royal Commissions Act 1902.

4  Schedules

                   Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Royal Commissions Regulations 2019

1  Section 4 (definition of Defence and Veteran Royal Commission)

Repeal the definition.

2  Section 4

Insert:

Defence and Veteran Suicide Royal Commission has the same meaning as in Part 4 of the Act.

3  Paragraph 7(c)

After “Veteran”, insert “Suicide”.

4  Paragraph 12(3)(b)

Omit “or 6OP”, substitute “, 6OP or 6OQ”.

5  Section 16

After “Veteran” (wherever occurring), insert “Suicide”.
