The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commissioners under section 23 of the Fisheries Administration Act 1991.

1 Name
This instrument is the Southern and Eastern Scalefish and Shark Fishery (Overcatch and Undercatch) Determination 2023.
2 Commencement
This instrument commences on the day after registration on the Federal Register of Legislation.
3 Cessation
This instrument ceases on 1 May 2024.
4 Authority
This instrument is made under paragraph 17(6)(aa) of the Act for the purpose of subsection 24(1) of the Management Plan.
5 Definitions
(1) In this instrument:
Act means the Fisheries Management Act 1991.
Management Plan means the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003.
(2) Any term used in this instrument that is defined for the purposes of the Management Plan has the same meaning in this instrument as it has in the Management Plan.
Note: Terms defined in the Act have the same meanings in this Instrument.
6 Determination of overcatch and undercatch
(1) For the purposes of section 24 of the Management Plan the ‘determined amount’ and ‘determined percentages’ for each quota species for the fishery for the 2023 fishing year commencing on 1 May 2023 and ending on 30 April 2024 are:
