This instrument makes consequential amendments to other ASIC-made rules to reflect the repeal and remaking of the ASIC Derivative Transaction Rules (Reporting) 2013 to become the ASIC Derivative Transaction Rules (Reporting) 2022, and, from 21 October 2024, in the ASIC Derivative Transaction Rules (Clearing) 2015 only, the repeal and remaking of the ASIC Derivative Transaction Rules (Reporting) 2022 to become the ASIC Derivative Transaction Rules (Reporting) 2024.

I, Nathan Bourne, delegate of the Australian Securities and Investments Commission, make the following legislative instrument.

Part 1—Preliminary

1        Name of legislative instrument

This is the ASIC Corporations (Amendment) Instrument 2022/934.

2        Commencement

This instrument commences as follows:

(1)        Part 1 and the items in the Schedules to this instrument listed below commence on the day after this instrument is registered on the Federal Register of Legislation:

(a)  item 1 in Schedule 1;

(b) items 1 – 7 in Schedule 2;

(2)        the item in the Schedule to this instrument listed below commences on the later of, the day after this instrument is registered on the Federal Register of Legislation, and 21 October 2024:

(a)  item 2 in Schedule 1.

Note:    The register may be accessed at www.legislation.gov.au.

3        Authority

This instrument is made under sections 901M and 903K of the Corporations Act 2001.

4        Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

5        Repeal of amending and repealing instruments

(1)     The repeal of an instrument by section 4 does not affect any amendment to or repeal of another instrument (however described) made by the instrument.

(2)     Subsection (1) does not limit the effect of section 7 of the Acts Interpretation Act 1901 as it applies to the repeal of an instrument by section 4 of this instrument.

1        Rule 1.2.1 (definition of Reporting Rules)

Omit “ASIC Derivative Transaction Rules (Reporting) 2013”, substitute “ASIC Derivative Transaction Rules (Reporting) 2022”.

2        Rule 1.2.1 (definition of Reporting Rules)

Omit “ASIC Derivative Transaction Rules (Reporting) 2022”, substitute “ASIC Derivative Transaction Rules (Reporting) 2024”.


Schedule 2—Amendments to ASIC Derivative Trade Repository Rules 2013

Insert:

Reporting Rules means the ASIC Derivative Transaction Rules (Reporting) 2022.

2        Rule 1.2.3 (definition of Reporting Requirements)

Omit “ASIC Derivative Transaction Rules (Reporting) 2013”, substitute “Reporting Rules”.

3        Subrule 2.2.1(4)

Omit “ASIC Derivative Transaction Rules (Reporting) 2013”, substitute “Reporting Rules”.

4        Paragraph 2.3.4(10)(c)

Omit “ASIC Derivative Transaction Rules (Reporting) 2013”, substitute “Reporting Rules”.

5        Subrule 2.3.5(1)
