CASA 30/22 — Air Displays (Temora Historic Flight Club) Ongoing Approval Instrument 2022

1          Name

                 This instrument is CASA 30/22 — Air Displays (Temora Historic Flight Club) Ongoing Approval Instrument 2022.

2          Duration

                 This instrument:

(a)   commences on the day after it is registered; and

(b)   is repealed at the end of 8 October 2027.

3          Definitions

Note   In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include: air display, crew member and passenger.

                 In this instrument:

display area means the area, at Temora aerodrome (YTEM), that is described as the display area in the Temora Historic Flight Club Air Display Manual, as the manual exists from time to time.

Note   In the Temora Historic Flight Club Air Display Manual, version 1.9, a diagram of the display area is set out in section 4.1.2.

organiser means the person:

(a)    nominated by THFC to be the air display organiser for the THFC air display; and

(b)    named as the air display organiser in the program of events for the THFC air display.

participant means the pilot in command of an aircraft being operated in the THFC air display.

program of events means the written program of air display activities, as the program exists from time to time, that is prepared by the organiser, and that includes at least the following information relating to the THFC air display:

(a)   the names of the participants;

(b)   the names of any crew members and passengers accompanying a participant;

(c)   the types of aircraft to be flown;

(d)   the kind of display flights to be conducted by each participant and any related requirements;

(e)   the name of the air display organiser.

relevant document means any of the following documents, as the document exists from time to time:

(a)   Temora Historic Flight Club Air Display Manual;

Note   As at commencement of this instrument, Version 1.9, dated September 2022, was the latest version of the manual.

(b)   Temora Historic Flight Club Standard Operating Procedures;

Note   As at commencement of this instrument, Version 9, dated July 2022, was the latest version of the standard operating procedures.

(c)   Temora Historic Flight Club Safety Management System;

Note   As at commencement of this instrument Version 5.5, dated July 2022, was the latest version of the safety management system.

(d)   Warbirds Downunder Safety Management & Operational Plan.

Note   As at commencement of this instrument, Version 4, dated July 2022, was the latest version of the safety management and operational plan.

THFC means Temora Historic Flight Club Incorporated, ARN 780559.

THFC air display means any air display, conducted in the display area, that is organised by the organiser, including each of the following air displays:

(a)   the September 2022 Aircraft Showcase;

(b)   the Warbirds Downunder Airshow 2022.

Note   Showcases and airshows are expected to be organised each year by the organiser during the remainder of this instrument’s duration.

4          Application

                 This instrument applies in relation to THFC, the organiser and participants, in relation to any THFC air display.

5          Approvals

        (1)     For subregulation 91.180 (1) of CASR, THFC is approved to conduct the THFC air display.

        (2)     For regulation 91.180 of CASR, each participant mentioned in the program of events for the THFC air display is approved.

Note   This approval is required for paragraphs 91.265 (2) (b) (see paragraph 91.265 (4) (e)) and 91.267 (2) (b) (see paragraph 91.267 (3) (g)) of CASR.

        (3)     For subparagraph 91.185 (2) (b) (i) of CASR, each participant mentioned in the program of events for the THFC air display as conducting aerobatic manoeuvres over a populous area, is approved to do so for a flight over a populous area at the air display.

        (4)     For subparagraph 91.185 (2) (b) (ii) of CASR, each participant mentioned in the program of events for the THFC air display as conducting aerobatic manoeuvres, is approved to do so for a flight at the air display.

   (5)    The approval in subsection (1) is subject to the condition mentioned in section 6.

   (6)    The approvals in subsections (2), (3) and (4) are subject to the conditions mentioned in section 7.

   (7)    This section ceases to be in force at the end of 24 September 2027.

6          Approval condition — THFC

                 THFC must comply with any requirement, mentioned in a relevant document, that applies to THFC and relates to the THFC air display.

Note   This includes the requirement under the Temora Historic Flight Club Safety Management System that THFC must follow the management of change process set out in that document regarding changes to its systems, processes or procedures that relate to the THFC air displays. This process includes that a significant change, as defined in the document, must be approved by CASA.

7          Approval conditions — participant

        (1)     The participant must not carry a passenger in any aircraft piloted by the participant in the THFC air display unless the passenger is named in the program of events for the THFC air display as a passenger of the aircraft for the flight.

        (2)     The participant must comply with the requirements of the following documents that apply to the participant:

(a)   the program of events for the THFC air display; and

(b)   the Temora Historic Flight Club Air Display Manual, as the manual exists from time to time.

Note   Under the Temora Historic Flight Club Air Display Manual, THFC must ensure that participants are briefed before any air display, including regarding the program of events, and any changes to the program.

8          Directions — organiser

        (1)     The organiser must comply with any requirement, mentioned in a relevant document, that applies to the organiser and relates to the THFC air display.

        (2)     The organiser must be satisfied that the carriage of a passenger in any aircraft flown in the THFC air display is required for the safe operation of the aircraft before naming the passenger in the program of events for the THFC air display as a passenger of the aircraft for the flight.

        (3)     Within 14 days of the completion of the THFC air display, the organiser must provide CASA with a completed CASA Post Display Report form, as the form exists from time to time.

Note 1   The post display report form is available from the CASA website at www.casa.gov.au.

Note 2   For regulation 11.250 of CASR, the directions in this section cease to be in force at the end of 8 October 2027.
