This instrument amends the Migration Regulations 1994 to address the ongoing impact of COVID-19 by providing for the extension of Subclass 300 (Prospective Marriage) visas to 31 December 2022 if the visa holder was outside Australia on 15 September 2021 and the visa was in effect on 15 September 2021.

1  Name

                   This instrument is the Migration Amendment (Prospective Marriage Visas) Regulations 2021.

2  Commencement

             (1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

                   This instrument is made under the Migration Act 1958.

1  At the end of Division 300.5 of Schedule 2

Add:

300.513 

                   Despite clauses 300.511 and 300.512, the visa is a temporary visa permitting the holder to travel to, enter and remain in Australia until 31 December 2022 if:

                     (a)  the visa was in effect on 15 September 2021; and

                     (b)  the holder is outside Australia on 15 September 2021.
