Aged Care Legislation Amendment (Improved Home Care Payment Administration) Instrument 2021
Purpose of supplementary explanatory statement
This supplementary explanatory statement amends the initial explanatory statement for the Aged Care Legislation Amendment (Improved Home Care Payment Administration) Instrument 2021 (amending instrument) in accordance with section 15G(4)(b) of the Legislation Act 2003 (Legislation Act).
Amendments to explanatory statement for the amending instrument
In Attachment A to the explanatory statement for the amending instrument, under Schedule 1, Part 1, Item 1-Section 4, after the definition of suspension period, insert the new paragraph below:
The amending instrument incorporates by reference the definitions of the Rowland Universal Dementia Assessment Scale, Psychogeriatric Assessment Scales and KICA‑Cog in section 4 of the Subsidy Principles 2014, a disallowable legislative instrument made under s 96-1 of the Aged Care Act 1997. Those definitions are incorporated as they exist from time to time, in accordance with section 14(1)(a)(ii) and section 14(3) of the Legislation Act.
Section 4 of the Subsidy Principles 2014 incorporates those assessment tools by reference and as of 29 November 2021, it incorporates them as they existed on 1 August 2013.
The Rowland Universal Dementia Assessment Scale, Psychogeriatric Assessment Scales and KICA-Cog are cognitive assessment tools that are used to assess a person’s level of cognitive impairment. The Rowland Universal Dementia Assessment Scale is a tool which can be used to assess persons from culturally and linguistically diverse backgrounds. The Kimberley Indigenous Cognitive Assessment (KICA-Cog) is a tool to assess Aboriginal or Torres Strait Islander persons living in rural or remote areas. The Psychogeriatric Assessment Scales are tools to assess all other persons.
